Default Advice Required

I approached Alliance and Leicester to claim back £350 in charges using the templates from the library. They tried to fob me off with their 'test case' line but I have persevered (surely as they are not involved in the test case it has no relevance at this time?) Anyway, I have received notice from Northampton (I used Moneyclaim online) that they intend to defend and I have received their defence via the post. Should I play the waiting game? Has anybody else experienced this?Thanks for any forthcoming advice.

Hi macca. When you ask 'should i play the waiting game' can you expand on this a little further please? E.g., you've received a defence but have you also received notice that your claim will be stayed?

Hi. Thanks for the quick response. I have not had any notification that the case is to be stayed, just of the banks intention to defend, as well as a copy of their defence. I just wondered if this is further 'intimidation tactics' before they pay up. (I reclaimed from Intelligent Finance some time ago and they intially said they would defend and then paid out) Thanks, Macca.

If you've received the bank's defence and you haven't had notification that they intend to apply for a stay, what should happen next is that your claim will be transferred to your local county court - you'll be notified of this (if you haven't had anything in writing in the next few days, contact Northampton for further info).

It's standard for them to issue a defence for most claims TBH. The difference at the moment is that most claims are being 'stayed' because of the test case........... but you'll know whether this is the case in the next few days.
