Hello

My story so far:

I have claimed twice against HSBC and both times won without getting a court date. I claimed against A&L for my Nan and she received a prelim court date but suprise suprise on the day of the hearing, she received a call from the solicitors (Wragge & Co) offering full settlement which she obviously accepted. I then claimed against Halifax for my friend and again won without going to court...

I am currently claiming against A&L for another friend (Sue - hence thread name!) and she has just received an allocation questionnaire to submit, which I am going to complete over the weekend..

I just really wanted to put something on the consumer action group website as its been v.helpful in the past and I wanted to check that we should definately continue with the claim... After reading all the other threads, I think its definately worth a go!

Anyway... thats my story (oh.. I am also claiming against Barclays for a friends bro and about to do court forms for that!)

HSBC claim 2! - Full settlement offer received 27/06 - £1,116
A&L (for my Nan) - full settlement received on day of prelim hearing - approx £1500
Halifax - (for a friend) - full settlement received 30/06 - £2576!
Barclays - (for a friend) - Court forms were due to be submitted but he wants to wait for results of the court case with OFT
A&L - (for a friend) - court forms submitted - claim 'stayed' due to OFT case

Just had a thought, how do I now up the amount of the claim to A&L to cover the cost of submitting the AQ? (the claim is for £3,232.30)

Hi C&D

I filled out my AQ and filed it with court and paid the £100.

You will have to add the £100 pounds on to the claim at the court bundle stage as there is section at the end of bundle where you can add it in.

As long as you have a receipt and you know the full amount that you are claiming for (including the court fees) then if they ever make an offer you can advise them that it is now more.

Hello

As suspected, a stay has been put on this claim. I havent seen the letter as yet and I have never been in this situation before. Should I be doing anything or is it a case of waiting to see what happens with the test case?

(Is it worth emailing Wragge & Co to see if they would be willing to settle for a reduced amount?)

Hi there, thank you for the update! It was not a suprise was it about the stay, and I dont think that there is too much that you can do with this one at the moment.

You mention about contacting the bank's solicitors Wragge & Co, suggesting a reduced settlement. i have heard of some bank charge claims still being settled even at this stage from reading other threads on here, and I suppose that the question would be, what would your friend be willing to accept?!
If the OFT rule in the consumer's favour, then your friend could be out of pocket, however if the banks come up trumps then it could be a letter well sent!
Even if you send the solicitors a letter, there is no guarantee that they will accept a reduced settlement, but if your friend is willing to accept a lower amount, then it may be worth the letter!
Keep us updated, as would be interesting to hear what the solicitors say on the bank's behalf, if you send the letter about reduced settlement!

Has anyone had a payout from A&L since the stays have been put on claims or since the court case??

I am claiming for a friend and she could really do with the money at the moment.. I am wondering whether it may be worth emailing Wragge as I didnt before?

As you have read most cases have been stayed,due to the
test case,
so there is not many payouts at the moment.
There is no harm in emailing wragge anything is worth
a try.

I figured that would be the case... I might see whether the lady I am claiming for wants me to email Wragge. She is quite poorly at the moment and may need to give up work for a while so will need the money..
