Default Addski v's A&L

Hello people,

I started a claim against A&L 2 months ago after I came home from getting married in France to find the best part of £350 in charges applied to my account because my dozy recruitment agency hadn't put my money in.. Anyway, I got to LBA stage but then the test case started and I thought I would put in hold. I've managed to keep my account in reasonably good shape avoiding charges until now except a couple of unauth overdraft charges (from the period I went overdrawn) that they add on to steal even more money off you. Today I received a letter from A&L saying that I had a unpaid DD £34 charge on my account for a DD I cancelled in May. I promptly rang them up saying I cancelled the bloody DD and they said I should have cancelled it with the company I was due to pay (they conveniently didn't tell me at the time I cancelled it). I said, fine i'll cancel it with them give me my money back, he told me it wasn't their fault and said he would refer it but not guarentee my money back, he also said that the FSA have put on hold all charge refunds. I'm absolutely bloody fuming about this because the way I see it it was their error, I cancelled other DD's at the same time and had no problems with them.

I'm not sure what to do now, it's a shame for them really because i've got £80k going in to my account in 2 weeks and was going to open a savings account, I guess they are gonna miss out now

finally beginning to calm down now as was thinking about the best course of action. As I mentioned before I'm due to rake in a load of cash from the sale of my house in about 2 weeks which will mean I can finally free myself of these blood sucking leeches. I was thinking since the test case is slowing everything down it might be a better idea to wait until I have the funds in my account, go down to the nearest branch and just say I would like to close my account, i'm hoping they will ask why and I will just say that I am concerned about the way they run my accounts, at this point they will kiss my backside and give me all my charges back plus a box of chocs for the wife. Then the following week i'll transfer the money out and close the account. Do you think that this plan might work?

Definitely worth a try - money talks

Just say you know there is a test case pending but you feel that they have been unreasonable. You know they can refund charges as they have done so before - refer to this website if you want - In a calm and polite way say I want my charges re-funded and then I will leave my account with you - if not I will withdraw the funds - close my account and commence action so that I will be top of the pile when the case is finished. (You can still reclaim the charges even if you close the account)

It will be good for you to have the conversation when you have the upper hand
