Hello, Just wondering,

I sent both my court bundles out on the 28th July to Wragges and the Court (Rotherham) to be in for the 4th July. Although both my cases are currently stayed, I still haven`t received my Court bundles from Wragges/A&L.

Should I still have received them before the said date or doesn't it matter as its stayed.??

Did you get your dates mixed up.. "sent bundles on 28/7 but had to be in for 4/7"? Good that you got them done though. I realise that the courts give extra time for the defence to give their papers in, and often they dont bother, relying only on their initial notice to defend.
I'd give the court a call to see what they say, but now you have to decide whether to submit your objection to the stay or wait until after the Test case. Either way you have started the ball rolling and you will win in the end!!

:o Sorry, I am Rubbish, yes I meant 4/8 but I've dyslexic fingers.
I was under the impression that both parties had to send the court bundles to each other and the court before the 4/8 otherwise the case get kicks out.

the defendant - bank - can unfortunately just rely on original defence - thats why its difficult to get a judgement, but see Mimis thread she succeeded. there is a form you have to complete.so maybe you should do this ASAP

Let us know if you get a stay from court or bank - there is a new section under "general "

Yes I thought that too, but they never sent one in for me. Only the application to stay the day before my case! I sent my letter of objecting to the stay by special delivery to the courts and to Wraggs, to arrive the morning of the case, and when I got there their solicitors agent pounced on me wanting to make an offer. I accepted £200 less than my claim and went away without having gone into the courtroom.. a very happy bunny indeed.
