Default gilly70 needs help with court proceedings

Hi
im sorry but i need help again just got Notice of proceedings for Reading court need to ask 4 questions

1) on the paper work from the court along with A&L defence they are saying we have not particularised the claim .we have sent our list of charges with dates ,amounts,& type of charge to A&L court & Wragge ( actually we had to fax to Wraggge as they said they hadnt got it )hmm
what else did we need to do ?

2) A&L say charges are not a penalty but a fee how or what do we argue against this

3) do we phoneReading court and send them the copies of the charges

4)do we ask court if the particulars were attatched to our claim

Any help would be gratefully recieved as my head is spinning & ive got a headache with worry in case weve done something wrong
thanks

Has the court actually asked you for any documents yet ?

If not I would have thought that all they need will be in the court bundle that they will request - have they dispensed with AQ?

As you have put a new post and not linked to old thread I am not sure where you are with everything.

http://www.consumeractiongroup.co.uk...hat-youre.html

My local court have sent a copy of the defence but have not actually asked for anything from me yet.

I think that you should probably call the court to check when they need the fee - or email them if possible . best not to slip up at this stage.

let us know how you get on

Smile Re: Help with N1 and POC

Hi, I have just completed the N1 form and modified the 4 page POC [posted by Michael Browne] to suit my situation.

Just a couple of questions now:

a] Do I post both to my local County Court? [Warrington]
b] Is there a standard cover letter to send with them?
c] Do I at this stage also send my detailed list of bank charges and dates?
d] The bank charges list has altered slightly since I initially sent it to Alliance & Leicester due to increased interest and charges since I started in May, is it OK for me to send the upto date list?
e] I assume I receive a claim number at a later date?

Getting scared now, not very good at all this legal form filling in stuff - all help is most appreciated!

Red face Re: gilly70 needs help with court proceedings

Please can anyone with with this dilemma its a whooper!!!!!
we decided to settle for less than the amount claimed as even though we have a court day 31st aug & its still going ahead we will have mega probs printing out our court bundle as no printer at present ours broke husband can only use the one at work when no one is there ie weekends but its risky.
we settled on condition the money is in acc in 7 days got letter to confirm this from wragge but A& L say it may be later as there busy !!.
Reading court say still produce court bundle if money not in by tues 14th aug & say why delay in sending it
QUESTION does it matter that we have already settled if we need to go ahead with court case im confused now can anyonew help with this
