Sorry Caro, i have had no speech all week cos of MS so been unable to ring myself and they wont discuss with anyone else due to Data Protection Act. SPeech more audible now tho so will ring first thing monday morning

early on in your thread you mentioned them taking charges from your benefit monies. have you had any help with this? I have seen on another thread that the banks are not supposed to do this.

If you want I will look around and find the letter or link?

found it anyway- go to debt action group - general debt - sticky thread - is the bank taking your benefits?


i read that you may have to send the letter on a weekly basis - but if you have it typed out ready for the price of a stamp it may be worth it?

I wouldn't get into phone calls to negotiate anything It is always best to have everything in writing. I'm not clear what stage your claim is at now. What was the last thing that you heard from the court.

Regarding taking benefits, jansus is right that they should not do that so you should send A&L a letter of appropriation.

It was the court i was ringing Caro, see what they say. I dont call the bank at all unless its essential, its about the only thing i do make sure of lol, that its all in writing via email or post

Janus thanks alot for that, i think there has to be a way thru this via the government as now u have to have ur benefits paid into an account of some sort surely they need to give us some protection. A+L due to take another 50 this weds, which is going to leave me mega short again. Im in process of swapping everything over to my other account anyway and then preparing prelim/lba for the charges since i started court proceedings. Caro a big thanks for the help... i dont think we can say it enough to you and all the other mods here!

Had defense, had AQ from them and its with the judge now (they asked for a months stay )

Ok spoken to the court, they told me its gone to the district judge and they cant comment on wether they will get a stay or not, its down to him, and depends who i get at the time. Wait and see now

Not heard a thing from Wragge and co, should i be doing anything else while i am waiting such as nudge letters? or sit back and wait for judge?

On another note i have threatened YB with action this week, as i say Robertson Holbrook is dealing with it but they refused to send them my statements, so i chased them up and loads were missing, i chased them again for missing ones twice now so told them blatently they have 10 days to get them too me before i file complaints to everyone i can!

The defence you've been sent by A&L is fairly standard now and I should think you will hear from the court soon about this. If you're up to it, give them a call.

As for YB and their non-compliance with S.A.R - (Subject Access Request)'s - don't start me on that one!

oooo ok will do jansus, good to see someone getting somewhere again after what seems to have been a stale few weeks.

Caro spoke to court early last week and they told me its with the judge, they dont know yet wether they have been given the extra months stay or not yet.

As for YB (renamed Yorkshire *ankers) they are trying to pull a crafty and i gave them to the end of the week to have the missing statements. Must have cost them a fortune in paper/ink and postage as they now sent me 3 lots of statements (6 years worth) and still missed the same ones off....

I think you need to hear from the court to find out what's happening. If it was being looked at last week they should know something by now so ring again. I'm not a fan of nudging the banks and believe in letting them do the running, while the court act for you. After all you've put it in their hands now.

Yeh i am waiting for the letter confirming the date etc Caro so i can see what i actually need to take etc...

Anyoldname, i logged into internet banking and where you click on statement it asks you for the month and then what format you want to download in, not sure how far back it goes as i have only been with them about 18 months

Ok i am stressed lol, i have received my details from the court. Its been set 'Notice of allocation to the small Claims Track (Hearing)

Gonna have a break this weekend and start sorting all the needed information. I downloaded all the statements, and heard these were ok, please confirm this is right b4 i start panicking more hehe.

There is no mention of the draft direction request i applied for and they have scheduled a full hour for the hearing
