Default nervously waiting -- ***WON****

hi all
asked for and recieved bank statements, sent prelim request for refund got back the standard reply but do I now go for the money claim or send an LBA 1st? Much of the LBA looks the same as the prelim that I sent but dont wana cock things up now! Also any advice on completing a moneyclaim online would be great help . thanks x

Yes, it is confusing, but if you keep looking and reading you'll gradually get the hang of it.

Remember this could, although unlikely, end up in court and you need to be sure of what you're doing before you do it. It's not a race, so just take it slowly but surely.

OK sent lba on 4th rfecieved reply today from 1 Mr Colin Hughes, who is very sorry to hear of my disappointment and has sent me a nice leaflet explaining that it could take up to 56 days to follow their complaints procedure, even though the lba clearly states I expect a resolution within 14 days. To be honest I cant believe that Im even getting a response from them at all!! So here we go

I DO CONTINUE AFTER THE 14 DAYS HAVE EXPIRED DONT I??
Im not being unreasonable by not allowing them their 56 days??

The 14 day deadline is up today and I ve recieved a letter SIGNED! from Mr S Mcguffie stating that he has reviewed my complaint but the decision not to refund charges remains unchanged and also that if he does not hear from me within 8 weeks they will close the file on this complaint. Is this usual? I havent seen anyone else mention this as a standard response. I intend to continue now with money claim but I was a little surpeised by this letter.

I got one similar to the one you describe. Basically you have got a refusal. Ignore the guff about closing the file it's their file they can do with what they want it affects you not one jot. Mr. S Mcguffie seems well named.

Stick to YOUR schedule. If the letter was the Letter Before Action and the time is up then act, initiate your money claim action. If it was not the LBA then you might care to send them one but if it were me I would not waste my time as they have already had their chance to consider your claim and have rejected it.

One advantage of spinning it out with an LBA is that, provided they continue to refuse, your claim via MCOL is racking up interest at 8%PA, not an altogether bad banking rate.

Ok Filed Claim In The Courts Today Now Just Crossing My Fingers And Hoping For The Best. Cant Help But Keep Thinking I'm Sure To Be The First Exception To The Rule!! Not Usually The Luckiest Person, But Hey We'll See. Do They Usually Lodge A Defense At A&l??

Default It Doesnt't Have To Cost Anything!!

I LODGED MY CLAIM IN THE COUNTY COURT TODAY AND AFTER DOING SOME READING UP BEFORE HAND FOUND THAT I COULD APPLY FOR EXEMPTION FROM THE FEE.
THE REASON FOR THIS IS BECAUSE I RECIEVE WORKING TAX CREDIT SO IF YOU GET W.T.C OR ANY BENEFITS IT DOESN'T COST YOU A PENNY TO FILE YOUR CLAIM!! I KNOW THEIR MUST BE PEOPLE WHO DONT TAKE IT THIS FAR BECAUSE THEY CANT AFFORD TO STAND OUT OF THE £120 WHILST WAITING TO HOPEFULLY WIN THEIR CASE. THE FORM YOU NEED IS EX160 AND YOU CAN GET A PDF FORM FROM H.M.C.S WEB SITE WHICH YOU CAN FIND A LINK TO ON THIS SITE.
I GOT THIS INFO BY TRAWLING THIS SITE, SO THANKS GUYS YOU KNOW I'M GOIN TO REMEMBER YOU WHEN A&L PAY UP XX

I got an acknowledgment of service stating A&L's intention to defend the claim on 5th September, I guess this is when I find out if I WILL be the 1st to go to court as Ive been dreading. All you successful claimants out there can you tell me how long they usually take from here? Have they ever entered a defence?
Desperately in need of some re assurance

I can relate to you on the nervoulsy waiting part, i filed my court claim on 21st Aug and received Acknowledge / Intend to defend letter on 25th Aug. As of today 11th September still no cheque.....i'm beginning to think i'l be one of the first to go to court!!

Patience i believe is the key....

I filed the claim in court on the 17th August and received the intend to defend letter shortly after.
I'm still waiting too! Only a few days now till they have to put in their defence.

oh my god!! so many others have waited much less time and recieved their cheque. Are they stalling for a reason, maybe they know something we dont. They were quick to acknowledge only 6 days. Now Im even more nervous. Maybe we ll all go to court.
I know I started this expecting nothing but now Ive come so far I ll be devestated if it ammounts to nothing. GOOD LUCK TO YOU ALL

Oh No!!! I have just filed today and was sure I would be the first to be in Court! Looks like we are all going to be waiting... I am going to keep an eye on this site every day now and wait for you all to get your money. (I'm sure we all will. But isn't is nerve racking.) It's just a shame A&L are so stubborn on this and I wonder how much extra money they have paid out in interest and costs? Will they ever learn????

Don't worry guys and girls it will all be OK.just think ,if the bank takes you to court, are they really going to tell the judge HOW MUCH it really cost to tell you that they haven't paid your direct debit,because you did have enough money in your account at midnight but then they took charges out before they paid your bills causing you to miss the payment and charging you £34 for the pleasure.

As many people have said before on this site they are willing to lose the money we claim from them as they are making BILLIONS from ripping people off for charges.they ain't going to kill the goose that lays golden eggs are they.Hang in there guys it will soon be yours (the money).
