Default Wood v A&l ***SETTLED IN FULL***

I recently sent my "Prelim Approach Letter" and yesterday received I reading along the lines of "thank you for your concerns, we are looking into the situation and will write to you with a more detailed response. Enclosed is a leaflet which explains the steps we will take to handle your complaint."

Enclosed was the standard Complaints procedure leaflet. Within the leaflet it explains the time scales in which A&L will write to me again. After 28 days they will write but in some case the may require more time to respond. In this case they can then drag the complaint out for 56 days.

Because they say they are investigating the compliant am I obliged to wait until I receive the response, even if this is 56 days? Or can I continue with proceedings and post my letter of action?

Any advice would be much appreciated.

You can ignore their timescales - this is your action to reclaim your money.

Simply follow the step-by-step guide as shown on this site, and don't be tempted to derail just because they think it should take longer!

I'd just say thanks for all the great info in the forum. Please to say that I received a cheque for my full claim against Alliance and Leicester yesterday!

Having never made a claim before I was very nervous but I stuck with it and got my reward in the end.

Just one last quick question! Now that A & L have settled out of court is it my responsibility to register the claim with Money Claim Online as SETTLED? The user guide reads the following so I assume it is but just thought I’d check: -

“Paying the claim in full

If the defendant chooses to pay the claim in full, including the court fees and costs, he will send or make payment direct to you. Once you are satisfied that any funds have cleared, you may wish to notify Money Claim Online that the claim has been paid in full. You can do this by email, telephone, fax or letter.”

nice one mate,how long did they take to settle from the date of the second letter?.And how much did you claim?
just in trested as i sent my final letter befor action yesterday for £3150.

It was only a small amount, £315.42. They applied for the additional 14 days to put a defence together but paid up within this time.

I have just received a form from Money Claim today to confirm that I have received my payment and I can confirm I wish to stop proceedings.

Sorry Robbiedonkey, from 2nd letter they gave me the standard letter again. Follow this up by issuing your claim online with Money Claim, it will cost £30 but you do get this back, and as I said above they paid within 28 days. Estimate for you at this stage 2 months tops if it goes they way mine did.

Congratulations Bazza. I have merged your threads so people claiming now can see how long it has taken you. You are living proof that the FAQ's and step by step instructions work if you just read them and follow them. As a mod it is heartening to see someone succeed who had just done the research and got on with it without the need to ask questions that are clearly addressed in the FAQ's etc.
