Angry Gibb v A&L Bit of advice needed ***SETTLED***

Hi all

Hope you are all well.

I sent of my Data Protection Act on the 17th July they sent it back saying there was no cheque in it, THEY HAVE LOST IT!!!! as I know there was a cheque in it as I am pretty strict with my chequebook!!!! So I sent another cheque off with the letter. My question is the 40 days are up on the 26th Aug (give or take) and they still havent taken the cheque off nor acknowledged the reqest.

Should I call or send a chaser letter (any templates would be greatly appreciated) ?

Are A&L slow usually at sending out information?

Hi there,

I would suggest calling them to see if they have received the letter. If they have then regardless of when they cash your cheque they only have 40 days. Did you send your letter recored delivery, it is advised when sending letters such as these to A&L.

This probably doesn't help but I waited over 40 days for mine, i ended up sending them the non compliance letter from the library. Received them after about 50 days.

Waiting is a huge part of this process especially with A&L!

I have received some information from A&L on one account!! Surprise surprise they haven't sent me any info from my other account that I requested on the Data Protection Act!!! Will keep you posted.

In the bank templates library there is a Letter Before Action you can use giving them 7 days to provide the information or you will take action against them for not complying.

A quick question. Can you claim for more than one account at a time on MoneyClaim. Its just that i have a Basic Cash and a young workers account. They have failed to send me the BAsic Account info and have sent the Young Workers info twice!!!!!! They have 4 days left to comply with the extended deadline!!!

Should I just claim for the Young Workers for now and claim the Basic Cash Account later?

No reason why you cannot claim for multiple accounts on the same MCOL action.
Do your homework and ensure all the data is there. If they query any part of the information on any of the accounts it will delay the whole action.

Not a major problem but something to consider.

OMG!!! Letter from A&L today!! Guess what! They have sent the Young Worker Account info three times now!! With no explaination as to why the Basic Account isn't there!!

Im tearing my hair out at their incompetence!!!! I am going to report them to the Information Commisioner. They have had an extended deadline.


UPDATE AS OF 1453! Finally discovered why I wasn't getting statements! Basic Cash Account address was wrong. Despite me filling in a change of circ!!!!! So hopefully all will be resolved now!!!

If you continue not to get what you need and should get, it might be an idea to telephone the person or department from whom you are getting the info. A short discussion can often get the message accross more easily.

If you do telephone, remember to write confirming the conversation and most importantly what agreements for action were made.

Remember that the person tho whom you talk is an employee with little or no age to grind. It is highly unlikely (s)he is trying to be obstructive and if they are it will be because they have been instructed to be so.

Sent the prelimanary approach for repayment letter on 12/09/06 and today received a letter offering £125 goodwill payment!!!! I am claiming for £268 which isn't a lot I know comapred to a lot of people but it will help me greatly.

So should I send the letter in the template refusing settlement and stick with the time table and send in the LBA on the 29th Sep?

I would be inclined to write and thank them for their offer which you will accept as part payment and give them 14 days to pay the full amount or you will claim through the court.

I have no idea what they have been doing to the refund. They put £50 and took £50 out then put another £50 in. I am going straight to Moneyclaim. I think this is the best option.

Well after a disaster with Moneyclaim which is all sorted now!!!!!!(I put the defendent and the claimant the wrong way round so it looked like a&L were taking me to court!!!!!! )

A&L have acknowledged the claim on the 20th so this gives them a further 14 days they are really dragging this out!!!!!

Just received a letter from A&L containing two cheques. One for £187.35 & one for £36.63.

Hooray I won!!!!!!!!!!!!!!!!!!!!!! However they have stated that:

So I presume they are now going to give thirty days and close them!!

Will this affect my credit rating?
