Default No news is good news??? - ***WON***

Wow! finally got into figuring out this thread thing...
I have sent my letter to A&L requesting the total plus the interest, and haven't heard anything back. I used the suggested address from this site to send off the letter.
Should I carry on with the LBA coming up this Friday (23rd) and just plough on?
I think I am ready for the next bit - although i am hearing horrible things coming out of A&L... Help!

Yes send the LBA after 14 days, it's your time scale not theirs.

A&L have publicly stated that they will close acoounts of anyone who makes a claim against them, so now would be a good time to open a parachute account with another bank.

Great - thanks for that!
Is it necessary to send the letter registered? and a duplicate fax maybe?
Shall I stick to sending to the same address?

No. Just an ordinary First Class stamp is fine. No need to send it any other way unless you specifically want to for some reason.

Make sure that you aren't claiming the 8% interest at this stage, as that happens at the court stage.
Good luck.

no - i haven't done that. In fact it took me ages to get through that 1st hurdle and to understand that the interest referred to is actually the £ that they take out of yr account monthly whci you can claim for. It had my head spinning thinking about how to calculate the 8%.
I got the spread sheets and a whole load of support from VAMP ....she is a gem.

I have another Q.
Just getting ready to send my LBA to A&L - what is the 'schedule' that I need to send with it? - I read it here on someones post
- Also the LBA template mostly repeats what was sent in the 1st letter - can I just use the last para of it and say we are off to court in 14 days if.....etc...etc
- They just levied anothe £50 since my 1st letter - can I add that extra to my LBA?
J

The schedule is a list of all the charges (type of charge, date, amount). Enclose this with your letter

Stick with the template LBA. If it works, don't fix it.

Add any further charges to the LBA and schedule

Question Re: No news is good news???

I sent my LBA to A&L giving them 3 weeks before court action (as I am away before then). I have had a letter today saying my request for claiming charges back isn't valid according to the OFT, and they will not refund. They haven't acknowledged my LBA letter.
Along with this I have a standard isssue letter saying my banking facilities are to be withdrawn. (This account hasn't been used, and is only accruing charges ontop of charges). They have issued a 'final demand for payment' and are demanding full payment on the account + administration costs by 4th July.

My question is should I close the account myself, and pursue the money back from the charges as a seperate issue? Should I respond to their letter reitterating the fact that I will be pursuing with a court action?

No need to reply to their letter - just stick to your deadlines and follow the step-by-step guide.

Default Faced with account closure now

I have served up the LBA giving the date 14th July - but today got a letter saying they were proceeding with debt recovery action in 7 days time (11 July).
If my overdraft is transferred to a debt recovery team they will presumably charge for all expenses involved in that? Can I get these back too?
I am happy to continue with the court action against A&L - but the debt recovery team will be another department wont it? How do I deal with this situation now?
Help!?!

Send A & L (or/and the DCA) a letter telling them the account is in dispute

Re: Account in dispute

ACCOUNT NUMBER: XXXXXXX

Dear Sirs

I am writing to clarify that I am currently in the process of requesting a refund of bank charges unlawfully made to my account.

I note from your latest correspondence that youare propsing to issue me with a Default Notice on this account - I need to make you fully aware that I am disputing the sum owed and, as such, you must refrain from any further action until this dispute is fully resolved.

If you do not stop this default action and proceed by making any adverse comments on my credit reference files, I shall be forced to take legal action against you under the Data Protection Act 1998.

Your sincerely,
