Default sharmal v A&L - WON

I am waiting for a reply to a letter I sent asking for £68 in charges. This is now £102.

I sent a cheque to "I don,t know" Did not write on counterfoil because A&L cheque books don,t have them.

Cheque was for one of my organisations to send me Data Protection Act request.

Bounced, I am wiped out with charges now, do not even have the £100 to take Nationwide or A&L to court.

Point: The letter they sent me and I quote:

In each case I raised a failed transaction charge of £34 in line with our published tariff.Note: for items BELOW £10.00 this charge has been waived. Excuse me the cheque was only for £10.00.

God save us all from this lunacy.

Still waiting for a reply from them.

They have four days I will have to wait for 7 before I can send NI form, and do the court form.

Nat West offer a basic account which everybody seems to be able to get (even me). No cheque book or overdraft, but there is a debit card and you can do DD's and standing orders. Hope you are asking for defaults to be removed when your request your money back.

Finally got a letter from A & L, with letterr:

Dear

I am writting in response to your recent communication and was very sorry to learn of your disappointment with the srvice you have received.

Thank you for taking the time to highlight your concerns, we are currently looking into the situation and will be writting to you with a more detailed response.

In the meantime, I am enclosing a leaflet whih explains the steps we will take to handle your complaint.

These are

By day7 - Full reply
By day 28- Hopefully situation resolved
By day 56Senior Manager will deal with the situation.

How about I put a claim into you, you answer me within 14 daya or we go to Small Claims.

I will be putting a letter back to them.

Filling in the last part of moneyclaim today, now I have been paid. Another £38 gone to A & L yesterday. They bounced a cheque, for £10.00 again. They now owe me £250 in three months

Moneyclaim filed today. Only asked for the amount they owe me at the moment £238 plus court costs of £30. But did ask for interest at 8% but did not put the amount in, will this be OK. It is waiting to be examined by the court at the moment(my moneyclaim) because I could not do it till Friday when I got paid.

Since then they have had another £38 from me. Can I get this back as well, when and if they offer to settle up and how long does it normally take, anyone know.

Just for future reference, when I do the moneyclaim for Cahoot, do I add the 8% on to the total figure in the first instance e.g. charges plus 8%.

I'm not too botheredabout the A&L one but I would like to get it right with Cahooot as it is a lot of money I could be throwing away.

Any input gratefully received

Methinks you add the 8% at the moneyclaim stage, dude.

And yes, if A&L keep levying charges, you keep claiming em back! The more the merrier.

I think it depends on how long A&L want to play silly beggars with you before offering to pay. Once payment is agreed I think it is a matter of days, as you don not stop the claim until the money is in your hand.

When you do Cahoot, use the spreadsheet in the templates library to calculate the amount of interest and I think you show it as a seperate amount in the text on the Moneyclaim, but total in the boxes in the claim form, and add daily amount so it keeps on adding. (Not sure if that makes sense, but I hope so)

I just kept fiddling with mine until it came up with the right answer.

Thanks for that. I have worked out my Cahoot one, just got to write to them and ask for the money. I made a boob with the A&L, on purpose realy, they made me so mad. I did not send them the letter saying that they had 14 days to consider and then give them another 14 days before I did money claim. Iwrote asked and they said no, so I did moneyclaim, it was sent to them on the 3rd July, I have got confirmation today.

I just hope that this goes nice and smoothly I will be £300 better off. Thank you

I hope that doesn't prove a problem for you. Are you saying that you did not warn them that they had 14 days or you would take court action? If so, you could be seen as not being reasonable and giving them an adequate chance to put things right before resorting to court action, although I fully understand your reason. I dare say that it won't be a problem, but to be more sure of success you really need to stick to the tried and tested processes.

I appreciate what you say Caro, we will find out now though as they have acknowleged the claim today. Just had a look on Moneyclaim site. I am doing all my other claims by the book (forum). So it should not be long before I find out if they will reverse the charges or not, judging by what other people say on the threads. Will keep updating

I got letter off the court two days ago 12th July, A & L said that they will be contesting the claim, is this normal. Am I going to have to put another one in soon, they do like to bounce these £10 cheques that I send out to people to get my Subject Action Requests. They seem to be gobbling up half my wage every week at the moment and bills are not getting paid. Pity I cannot sue the bank for making my credit card get defaulted. If it was not for the charges all the time, there would have been more than enough money to cover it. That is another issue I suppose. The Credit card is with a different bank anyway, I will post the question in that forum

Yes Sharmal, this is quite normal.

Once you make your Moneyclaim it all becomes official, and then there is a set route that has to be followed.

The defending bank/b.s. has to tell the court it is defending the action. Then if they settle (as they seem to have been doing so far), you have to write to the court to tell them you have received your money and the case can officially be closed.

If A&L don't pay everything they owe you to date, then you can start all over again. Fun, hey?
