Default bttrev v abbey *** WON ***

I am new to this i have sent letters to the abbey requesting £6700 inc 8% intrrest.
I have also started money claim online and the abbey have said they wish to defend.
I have recieved GOGW for £1095 since Filling claim with the court
i have told the court of this and that i wish to carry on to claim the full amount.
do i now have to wait 28 days to see if they file a defence im a bit lost can any one help

Hi bttrev,

Abbey have to send a defence to the court within 28 days from the date your claim was deemed served. If not you can apply for judgement.

Hi I think i need help my MCOL claim was very brief and it said

abbey have failed to refund unfair bank charges despite have been asked twice and that i consider these carges do not reflect the true cost to the bank and that i am claiming £5769 plus intest under s69 £1472

Can i ammend this as i had the right hump with them and didnt think

ahh then you need to read the faqs to get an idea of what you need to be doing and then perhpas someone can help you put together and submit an amendment to your claim becuase its bound to attract a motion to be struckout if the particualrs are that brief.

I have posted my ammended claim to northampton court this morning many thanks michael for your help i used the templates and it sounds loads better .
In the post today can a letter from the abbey asking for my account number and a full break down of how i came to my £7241 total should i send the abbey a draft copy of my proposed amendment as it shows all the details they require can any one advise

Yes, you can send the shABBEY a copy of your amendment, it won't do you any harm and shows you to be polite & courteous!!!!

With it, send them what they are asking for, your account info and a copy of your schedule of charges, even though you've probably already sent it before!

I think when the shABBEY ask how people have come to the figure of charges, as they have asked you, I personally think that all they are asking for is a list of the charges they have put on your account over the years (your schedule of charges), not a physical mathematical breakdown that some people think they are asking for!!!!!!!!

Just a quick update

I have sent the SHabby a copy of my draft amendment alone with a cover letter. Also i have checked and my new N1 forms have reached the court ( checked online with royal mail) The abbey should recieve their copy tommorow

Michael is correct but i think he is presuming that you gave the court two copies of the N1?

I believe they will only send out what you supply.

So if you gave them two copies they would send them one.
