Hi to all I am a newcomer who has been busy reading all the different cases - esp Wizzkid and Jonesfamily etc.. I sent my Data Protection Act with £10.00 cheque on 11th May and like other people I have received the statements for the last 13 months and alone this has added up to over £3000. Like everyone else these charges were out of control and a knock on effect and has left us with some debts. I have opened another bank account and am in the process of transfering dd's etc... We do have our Mortage with Abbey as well but are tied in until march next year, can they demand I close this as well ? has anyone else come accross this, we have not defaulted on our Mortage. I know my claim with be for more than 7 grand and I am very nervous but after reading other peoples cases I feel really confident that we can claim our money back that has been (edit) from us! A massive thank you for this site its a life saver.

Hi yes when I have the final figures I will be sure to let you know what I do, mind you I probably will be looking for advice as it won't be a small claims court if its over £5000 will it?

No it will be fast tracked but if we can both work out a way to split the claim without them getting wind of 2 claims or asking for a second to be struck out we can claim the lot...going to be tough but I'm sure there will be some sharp minds on the forum that will help out.

Hi yes once I get the rest of my statements then I can add it all up and go from there. do you know of anyone else on the forum that has claimed more than £5000 and been sucessfull, as you say there are some sharp minds here to give advice.

i'm fairly new here so no i don't. however the course of action I'm hoping for is that Abbey default on the Data Protection Act request by not supplying sufficient detail so I can submit a claim for £4999 plus interest then claim the rest in a second claim once the statements appear. Other than that the only other option I can think of is to split the actual charges ie £4999 for unpaid DD's then whatevers left for the remainder..

Bearing in mind I have one account that incurred around £300 per month for over 6 months and eventually ended up closed due to the fact that charges nearly overtook my wages and i have just received this months statement stating £350 of charges it doesn't take too many months of that to get over the 5K mark If I look at an average of £150 per month for 6 years that alone = £10800 if you double that for 2 accounts its well over 20K.....realistically I think my claim is more around the 10k mark

the maths thing makes me think that a lot of claims could potentially be over 5K as that would only equate to just £70 per month over a 6 year period. If you think about it one DD for insufficient funds = £30 and an additional charge for being overdrawn because of that charge of £20 would mean £3600 alone...the knock on effect usually means a spiraling of charges which would easily take you over the £70 per month minimum.

The only danger I can see is that Abbey will request for additional claims to be struck out or merged therfore forcing a fast track application

One way to split a claim is starting from 6 years ago is to add all the charges until they reach £5000ish and make a claim for that. When, and only when, that claim is settled do you claim for the next period. That way the bank cannot ask for claims to be merged, plus on the 2nd claim the bank will know you mean business

Hi no I have not received them yet but I did call Abbey yesterday and they said that I shold get these in the next 5 days! Have you read Seminole thread? as his/her claim is for approx 11 grand and is going to fast track it so I have been logging on to that to see what happens. Are you thinking of fast track or still splitting the claim. Also how long did it take you to get your statements?

Not got any statements yet had a microfiche letter or letters see the thread for details. I'll keep an eye on Seminoles case but fast track scares me a bit. I'm looking to split and submit multiple claims, it may take longer but its a tried and tested method.

No I just received the microfiche letter on Friday sent a reply back to that reminding them they only had 29 days left to comply so I've got about a month to go before I get that far. This week I'm going to tot up all the charges from the statements I have and see how much that comes to...there may be enough there alone to claim £5000 already as my wife tends to keep a couple of years worth of paper work and the majority of the charges have been over the last two years.
