Default Colin & Claire v Abbey ***WON***

Been ongoing since early february and had only reached the stage where i was waiting for a court date from my local court.

My claim was for £3,022 + Interest and costs which came to nearly £4000.

I decided to send a nudging email and got a surprise when it was answered almost straight away with an offer of £3000. I declined and stated i would accept £3500 and on Sunday i got the mail saying they would pay the £3500 within 10 days!!!

I know its a little less than the full amount but we needed the money and there was no end in sight so im really pleased.

hi,i keep getting letters from abbey saying we are looking into it, you should here within 4 weeks.ive had two of these after i said i would be taking them to court.any advice?

Just follow your own timescale, if you have sent the letter giving them 14 days before you will take it to court then start the court proceedings as soon as the 14 days are up.

Abbey will keep delaying for 4 weeks at a time for as long as you let them so just stick to your own timescale not theres.

hi,ive now done the online moneyclaim and have to wait.whats worrying me is being prepared for court if I have to go that far.Did you prepare just in case?

excellent stuff.
I am at the stage where abbey have acknowledged my mcol claim and so now have until end of july to put in a defence.
Is it worth me sending a nudge email as don't really want to go to court and like you would rather the money sooner than later.
If so who did you email??

I would start getting prepared but i would wait until you have an actual court date before doing too much, if you have only just filed the MCOL it will be quite a while before you get a court date
