Default still waiting after 9 months

hi first contacted abbey in sept 96, went through money claim in feb this year, abbey filed defence transfered to gloucester court in march, judge singleton has stayed claim on two occassions the first for inadaquate poc, second for which he didn't give a particular reason, only really to give a chance for mediation, the case went back to court on 13/6 am now waiting for next decision.has anyone had to wait this long?

this is indeed along time to wai, but dont worry you should get your offer soon, do you have a spreadsheet prepared listing your costs to date, especially including £9.25 per hour for prep of court bundle, printing and copying and postage? ready to show abbey when they decide to cough up

thanks lula,i have sent a spreadsheet listing all costs, a bit confused about the contents of the court bundle but i am not yet at this stage, have just recieved aletter from judge stating that the case will be struck out deemed settled if no request for hearing has been filed by 20 july. I intend to request hearing, however am unsure whether to include letter highlighting recent events at hull, and pointing out the fact that the banks are abusing the court service and will probably settle at the last possible moment. is this advisable. thanks again.

Firstly, request a hearing, ring the court first and see if they have received anything from Abbey, have you emailed abbey to try and settle, do this and then when you get no response, (try and put a read receipt on it, or better still send an email and then a hard copy recorded delivery) then by the time you get a hearing, you should have either settled or they will settle pretty soon after getting ahearing date, this seems to be their mo just lately, but keep a log of all costs because you can ask for costs from Abbey or, BEFORE you agree to settle, slam in a wasted costs order
