Default Court Date V Abbey

Hi there guys (inc you girls aswell ), I have an impending county court date at Peterborough CC on the 28th June 2007; it is for a pre-trial review.

My questions to you all;

1. I have asked for and still not received my statements (requested Feb 2007), in my original claim I calculated an approximate charge for the last year then multiplied that by 6, then with the total I calculated the 8% interest.

HOWEVER, I decided that this was not very accurate and calculated the interest on a yearly basis, this was then submitted to the court and to Abbey.


How can I calculate accurate interest without the statements and will this affect my standing in court?

2. What is a pre-trial review and what paperwork do I need to take?? Has anyone been to a pre-trial review??

I am a bit late in getting to this site, my initial application was via Martin's money saving tips. I also realise that I won't be able to send and receive a reply with the "Disclosure request/demand for clarity" form as highlighted on this site.

Thank you, I am really starting to **** my self now, hope you can advise.

My Belief is that if you have requested the statements from the bank they have to provide 6 years worth. If they do not and you can prove you have written to them the court will help you with a reasonable estimate and make an order with this regard if they think the bank is behaving unreasonably.

But I would write to the Ombudsman and the OFT first and complain about your treatment and ask them to write to the Bank within the next 14 days, to supply you with your copy of the accounts!
