hi everybody. I posted a help me as a newby and was advised to post a thread on the abbey forum and tell you what i've been doing.
I watched the money programme and heard about the charges being refunded,I got my templates off the bbc site.
15th Jan 07,sent letter stating require £1795.00 charges to be refunded within 2 weeks as unlawful, if unsatisfactory,would refer the matter to court.Included photocopies of statements, and requested a breakdown of costs. All sent special delivery to my branch.
23rd Jan, received letter from Milton Keynes office. Thanks for contacting us,we will investigate here's a leaflet and we will write to you in 4 weeks.
30th Jan, letter stating full investigation carried out, sorry you're unhappy,charges correct,but will give you goodwill gesture of £223.00.
8th Feb, phoned Abbey and said not happy with offer,why give this money to me if I'm not entitled,will accept as part payment but see you in court.
Sent a letter saying same.
15th Feb took the case to her majestys,gave the courts copies of all,sent abbey head office the same. All correspondents sent spec. del.
27th Feb,county court letter, they're defending. 13th March offer £786.without prejudice. 2nd April courts with allocated questionairre.13th April,head of complaints letter,will look at your case,reply within 4 weeks. 18th April,letter,now been eight weeks sorry for delay. 17th April,court date set "stayed until 27 June". Judge *** in paperwork.
Anyway,that's my long story,made it as compact as I could. Any ideas? cheers your help would be much appreciated. x x x b

I think that might have been a bit too compact, are you saying that you now have a court date?

have you done a court bundle?

if you havnt you need to do one, look at the link, it will explain it all and how to do it, did they ever pay the GOGW into your account? did you do a spreadsheet with the 8% interest?

explain in a bit more detail please and then we can judge the best course of action. Who are you in contact with from Abbey Legal department?

READ THIS NOW if you have received a court date

also, is it possible that you can scan or copy out what was said in your last correspondence from the court.

Hi Lula,thanks for response.
I did receive the goodwill, didn't do the interest sheet. Originally I received letter from Banking specialist team;Andrew Nanson (business Manager).And Neil Monk (sen.cust. resolution Manager).Phone calls to Milton Keynes. Court proceedings and latest correspondents addressed to Abbey house,Regents Park London. They have filed a defence James Arrandale;legal officer.signed the defence.
County court letter states:
General Form of Judgement or Order.
Before Judge Dudley sitting at ***** county court.
Upon reading the court file and of the courts own initiative
IT IS ORDERED THAT the claim be stayed until 27 June 2007. to be referred to District Judge Dudley in paperwork on 27 June 2007.
I am going to start preparing my court bundle asap,saw the link which is extremely helpful,not sure if I send anything to court or abbey or just show up to court with bundle? Court has all correspondents and statements already. Should I expect response from abbey before court. Heard they drag heels sorting money out,been messing my ac. up, so 1st thing tom going to change bank ac.should have done earlier. any help would be great. Many thanks bon x
