Hi,

I am in the final throws of getting my claim dealt with, however, it appears that Abbey, are either holding off till the last minute, or quite happily about to make an appearance in court.

The hearing date has been set by my local court for the 4th June (this coming Monday!), and still no cheque though the post yet.

I have previously turned down two letters of offer, in favour of re-couping the full original claim amount, of which the last refusal letter from myself was sent three weeks ago.

I would have thought there may at least be some courtesy on behalf of Abbey, to at least say whether they are going to court or just going to pay up.

Very unproffessional, and very rude.

Consequently, I am just constantly trying to hold on to see if the post can bear any good news, but is now driving me mad.

Do I now write to the court, and ask for the Defence to be thrown out?

Can I do that?

Or do I e-mail Abbey, and ask what the hell they're playing at?

(Bearing in mind that I do not actually have a contact e-mail address, for anybody there, yet.)

Is this an indication that it will go to court?

Or has anybody had a cheque come through as late as the hearing date?

Please, I just want to know either way, so I can put my sizzled brain to rest, or alternatively prepare for further battle.


I would really appreciate any help or advice.

have you submitted your court bundle?...have abbey? if not then there is a possible breach of a court order which would give you the opportunity to get the defence thrown out and judgement in your favour. bit more detail behind it is required

Personally, I wouldn't phone them. They are unlikely to attend court but have been known to hang it out right to the last.

As you have a court date very soon I would pm a Mod if I was you - they will give you the best advice. Try Gary H.

UPDATE! I have managed to get my facts completely wrong!

The notification that had been received from the court, was a standard order of stay, quoting that the court needed to hear from either party by the 4th June 2007.

This however, was read by myself incorrectly, and mis-took as the court date.
I apologise to all that took the time to come back with advice, i am an utter arse!

However, I have now applied to the court manager for further direction to the case, which was sent out to the court-house on the 4th June.

I had since heard nothing from either abbey, or the court, so phoned them up yesterday, to which i was told that the resident judge is off ill, and the temporary stand -in judge had a whole load of cases waiting in a similar state.

They apologised, and confirmed that i will have some sort of response from the court by the end of next week.

I hope so, as i am on the verge of giving up thinking about it all.

I am so disappointed that an, aparently proffessional institution, as a bank, has to be so unproffessional, under-handed, and careless with their customers.

Does anyone have any further advice.

Will i be compromising my case if i try to corresspond with abbey themselves to try a move things along?

I'm going to give it a go, with a slightly hacked version of the ICY chase letter, as it looks like Abbey and Inga have been seriously bitten on the arse by the latest "claim sunami"!

The reason for the hacked version is because I have not charged interest, so will look for close as poss to 100% original settlement.

Maybe in the future, Banks will think twice about treating us like utter twits again!

Bloody tossers, the lot of them!

Any finance based company, they're all kiniving Butt Monkeys.

Just looking at a new insurance policy for a new motorbike, and finding the premiums varying by about £1200 between cheapest to most expensive!

Then discovering that one company (shall remain un-named) wants to charge 28% APR for paying monthly installments by direct debit!

What planet are these insaine idiots from?

I think Abbey were hoping to fob me off, twice, with myself, both times declining.

I told the court about how Abbey had come to a "final settlement", and the clerk ****ed herself laughing, and said they obviously have started up their own in house court system!

The law is the law, and it's the judge who makes the descision, not some bod with no interest whatsoever.

I really don't want to ever bump in to any of these half-witted individuals, as, (and I know i'm not the only one), these oxygen thieves ruined myself and my family for four years, trying to cover the extra expense of loans to cover the charges incurred.

To think that these individuals really don't give a flying turd's consideration to the fact their so-called institutions in short are bending and breaking common law, with total disregard for their customers.

Angry and hateful is the mildest term of describing how I feel towards these trust abusing con-meisters.

I started my battle in January 22nd with request for info.

Got Full and final offer this morning, they're paying me 100% of my claim including all the interest. They had one week before we were in the High Court with this, so you see, stick at them, they do pay up.

Godd luck, not that you'll need it, just perseverance.
