| | Basic Account Customer | Ceri vs Abbey Hi there!
Have requested my statements from Abbey and paid the £10 but all i received was a spreadsheet from the last 4 years which detailed the months and years and which charges I incurred, no specific dates and details very vague.
Should I write back and request my full statements and ask them to send me the full 6 years which I paid my money for?
Any help is much appreciated

If you find the thread Jules1973 she has posted exactly what you need to send to them. But I think it is Letter 2 in the templates for non compliance just tweak it a little with what your requirements are. I sent the same letter and within a week i have the full listing of statements showing charges. You won't get anything better than that, it still doesn't show your running balance but at least you get the complete list with dates on
Hope that helps

| Re: Ceri vs Abbey Hello Ceri,
Has your 40 day deadline passed?
Have they cashed your £10 for microfiche?
They do normally send the 1st 12 to 14 months of statements, then microfiche data.
Did you send a Data Protection 1998 Subject Access Request letter?

| | Basic Account Customer | Re: Ceri vs Abbey I didn't send the Subject Access Request. I first requested my statements on-line, to which I received a letter asking for £10 and the period I wanted statements for. They did say they would send the rest of the statements, but all I have received so far is a one page spreadsheet detailing just the charges incurred.
Do I need to send the letter asking for the actual statements or will the spreadsheet be OK?
Thanks for you replies |

| Re: Ceri vs Abbey Hi Ceri,
you need to send out the Subject Access Request request on this link: 1. Data Protection Act, Subject Access Request letter - List of charges
Send it by special delivery to the head quarters address, obviously adjust the letter to state that you have paid the £10 fee already
Address to send to: Abbey National PLC Abbey National House 2 Triton Square Regents Place London NW1 3AN
They then have 40 days to comply I would suggest you read the below link which takes you through step by step: Example Step-By-Step Instructions - Now updated to reflect the OFT court judgment
Its best to follow the step by step guide in order, if after 40 days Abbey fails to comply you can report them to the Information Commissioners Office (Information Commissions Office) Obviously you can only do this once the 40 day deadline is up.
Good luck!

| Re: Ceri vs Abbey Hello Ceri,
You have a summary of there design they may not release the other two years to and you will miss out on money. They need to send you the full 6 years and will stall and stall unless you send out an Subject Access Request.
I think everyone on the Abbeybank forum would agree Shabbey are the kings at stalling.
I know its a bit long winded but it is the best way to go about it, but when you have all the charges you can enter a accurate claim.

| Re: Ceri vs Abbey Hi Ceridwen - to file your case you will need to provide a summary of charges to the court which is dated and itemised - you would not be able to do this with the info they have sent you so far, so yes, you do still need to send the S.A.R.
If you follow each step on here you can't go wrong. Good luck.

| Re: Ceri vs Abbey Sorry, what I should have said is that if I am right in my thinking, the summary they have sent you does not give specific dates of when the charges were taken - that's why you need the proper summary list and not the spreadsheet as you will need to put the actual date for each charge on your summary when you file at court.

| Re: Ceri vs Abbey Hi Ceri - yes, you would need to put the exact date on your summary - otherwise it will mean you estimating - there are some threads on here where peeps have done that but knowing how difficult Abbey are I personally would make sure every base is covered!!
If you have paid your tenner - that's what you are entitled to receive so I would say send your S.A.R and as advised earlier, do things by the book - they will have nothing to come back at you with then.
There are lots of good people on here who will help you at every stage - get your S.A.R sorted first - it's all a bit long winded and takes time but is worth it in the end. You'll get there!! |

| Re: Ceri vs Abbey Sorry, you don't need actual statements - although if they send you those they are a bonus - what you need is a complete list of transactions and charges for your account as stated in the Subject Access Request wording.
As somebody posted earlier - just tweak it to say that you have already paid your £10 (did you send a cheque? - so you have proof) - another tip with Abbey - send all communication by Recorded Post - you then have proof of posting & delivery if they claim not to have received any of it.
It'll be okay.

| Re: Ceri vs Abbey Hi Ceri,
the exact date is also important on each charge as you will be wanting to claim back interest from the exact point they took your money.
Have a lovely evening!

| | Basic Account Customer | Re: Ceri vs Abbey They debited the £10 from my account so that would show up on my statement.
Will definately send the Subject Access Request. The statement of charges has just made it easier for me to work out how much I am owed by them. About £500 so far, but still have have 2 years of statements to come
Thanks for all your advice, I just wanted to make sure I am doing everything by the book |
