Default Sunil v Abbey

I am doing this on behalf of my other half - am now at the point of requesting draft order for directions from the London Mercantile Court at the directions hearing June 15th (filing by post rather than appearing in person)

Rough timeline below:

Total claiming

01 May 2006 - Subject Access Request request
6th Dec 2006!!!! - statements received
15 Dec, 2006 - 1st letter requesting payment sent
10 Jan, 2007- LBA sent
19 Jan, 2007 - "We are looking into your complaint' letter received
22 Feb, 2007 - MCOL claim issued
2 Mar, 2007 - Abbey acknowledge claim and ask for more info (even though schedule of charges already sent with LBA)
20 Mar, 2007 - Abbey send letter with copy of their Defence and offer to refund £289.23 (out of £578.46) as gesture of goodwill. Refused.
21st Mar, 2007 - case transferred to local county court
9 April, 2007 - Allocation Questionnaire returned along with request Draft Order for Directions
9 May, 2007 - Case ordered to be transferred to Mercantile Court
21st May, 2007 - Letter received from Royal Courts of Justice Group. Case will be heard for directions as part of a group of similar cases on June 15th.

Will keep you posted!

Regards,

Lori

Hi
Hope all works out good luck.

When they entered their defence did the court automatically send you the allocation questionnaire or did you have to contact them. Abbey have just entered their defence of my claim and wondered what happens next?

Cheers

Smile Re: Sunil v Abbey -WON!!!!

Just to let you guys know - Sunil received a letter from Abbey today (the day before the directions hearing was due to take place) offering payment in full of his claim!!! They said they will be transferring in a total of £589 into his account - It looks like (and I'm hoping) they may have forgotten they already paid £200 odd in a few months ago so we could really be quids in!

Thanks so much for the forum - really wouldn't have been able to do it without you guys!!! Donation shortly forthcoming.

Now it's Barclays turn!

Good luck to everyone else - just want to say don't give up or be intimidated, this took almost a year but was worth it in the end.

all the best,

Lori
