Bullymeister V Abbey Hi there, I wonder if someone could help me. I have been reading the forum for a few days now and seem to get more confused lol (It doesn't take much!!)
I had my 6 years worth of statements, eventually, and wrote a letter requesting a refund of all charges etc on my account. (Letter copied below). After a couple of letters from them stating they needed more time they eventually wrote to me, 22nd May, saying ''Although the charges were correct, as a gesture of goodwill, I am happy to refund £80. Your account will be updated within the next 10 working days.''
There is also some stuff on default notices and that they are not able to alter any information held with a credit reference agency.
What do I do now?? Do I need to stop them depositing this £80??
Now I am asking for £995 which is not as much as most. Although it would be nice is it worth, in this case, all the potential hassle??
Will they demand my overdraft back straight away, which is £1400??!!
Thanks in advance
Danny Dear Sir or Madam, Ref: Account number: XXXXXXX I would like to request a refund of all the default charges that have been applied to my account over the last 6 years. These charges were made at times when I was most vulnerable and had a significant effect on my life. Under the Unfair Terms in Consumer Contracts Regulations 1999 charges must reflect administration costs and cannot be punitive. I believe that the following £995 is unlawful as they do not reflect the true cost of going into an authorised, and on occasion, unauthorised overdraft. Please repay this money in full and remove any default notices within 14 days. If this is not done, I will begin a claim against you for the full amount, plus interest and my costs. Yours faithfully, |
