Hi Knelly, Charleyfarley directed me to your thread, Ive just had my letter of transfer of proceedings to Pontypridd court and after phoning them I was told that it would be transferred to Cardiff..OMG I cant believe youve gotta wait until Nov....and Im about a month behind you...
its probably so far away because all the local courts are being transferred to Cardiff..so Im probably looking at Dec or even Jan(assuming it wont be stayed)...really p155ed off now...
Btw I received the same letter about the oft case this morning as well...

Hi Nowayjose!

I was appalled that Abbey couldn't afford me a proper letter heading ~ I've a good mind to complain!

You never know, you might make it to the November directions hearing as well ~ I think they stock pile the cases, there's a hearing on 14 August (i was hoping to get in on that one but missed it!).

Never mind, while we wait you can join me with the knitting ~ Bonnie has given me an interesting order and says this is my chance to make millions!

Received a General Form of Judgement or Order today transferring to Cardiff County Court for the attention of District Judge Hendicott...is this the same as you....have you started your court bundle yet?? Not sure when I should start

On July 6th I had a notice of transfer of proceedings telling me It'd been transferred to Cardiff

Then on July 12th I received a general form of judgement which says

It is ordered that
Before Distrct Judge (Same as yours!) sitting at Cardiff County court

Upon neither party attending

1 Directions will be given in this case by the Designated Civil Judge (someone different) on the 14th November 2007 at 10.30am at Cardiff Civil Justice Centre.

2 The parties may appear in person or make written representations as to how the case should proceed provided a copy of the representation os sent to the Court and the other side at lease 7 working days prior to the hearing.

As it's a directions hearing there's no need to get a bundle ready! ...........If I'm wrong on this point can someone tell me quick - before I run out of time to get the bundle sorted! !

Hi Knelly. how many stitches till November...

Also, I got my letter from Abbey, they are going to request a stay with the court, so I am starting to get ready to set it aside if they do. Clippy is at the same court as me but in a couple of weeks time so we will see what happens with that case and if it gets stayed. Mind you the letter seems that they feel quite sure that they would get the courts to have the case stayed.

Any news on Cardiff and what they are presently doing!

So what normally happens in a directional hearing..what do you have to bring with you and will a representative from Abbey be there...and what happens after the directions hearing, sorry if I sound thick or these questions have been answered before on the forum but my head is spinning from all the 'legal' speak...I need plain English.I feel I should be doing some preparation now or am I too early?
Can anyone help

well i think in a directions hearing the abbey should be there but more than likely arent and at it the judge deciedes on where it should take place like small claims and what court it at i think but double check if your not sure and as for getting stuff ready its never to early to get your court bundle ready as it takes a while have you got an AQ yet or have you already filled that in then ?cos that might be next excuse if this is a bit befuddled but only just up and head a bit buzzy but do ask if your not sure ok xxxkia

I agree with Kia, the directions hearing is where the judge decides whether it's for the small claims court (which mine should be) or he could allocate fast track if it's over a certain figure (5K I think).
No need to do a bundle for this but as Kia said, no harm in starting to get the info ready in case you need a bundle!

I havent received an allocation questionaire yet...what info do you have to supply for this?.... my claim is for just over £2600 so I will probably have a claim through the small claims not fast track....just looked at martin lewis' site and it seems that the judge in Cardiff is requesting a stay on all claims.. any info???

hiya nwj err i think all the courts are thinking about this but can u imagime the chaos if they stay all the claims for a year itll be mad so i dont know about cardiff very possible and as for AQ when it comes ill be able to help with it ive still got mines it is fairly straight forward although it looks daunting so dont worry if not me someone will alot have filled them in so no worries ok xxkia

I know I ll get great help on this site... wouldnt have got this far otherwise....Do you have to pay for an AQ? if so how much? and do you have a deadline to pay this.?.. money a bit tight at the moment as husband just returned to work after redundancy.. still waiting for first full months pay and playing catch up on a mountain of bills...

AQ fee is £100, it normally says when you have to pay and return the AQ by on the order you receive telling you to file the AQ

Sometimes, usually yes but in a claim of mine the AQ was dispensed with and the fee was never requested, the claim has continued without any mention of the fee, i think i may have just got lucky
