I am claiming charges against abbey and have received a defence from them. I'm unsure of what to do next...apart from panic! Please help/advise me.

I am doing the same with Abbey at the moment....

I received their "defence" too...if you check out other posts on this site (and there are plenty going round!), you will see that this is not unusual. A lot of the banks these days are taking the process as far as they can in order to intimidate claimants.

Read up on the posts that take you through the step-by-step process of claiming your money back; it helps to note that the advice given is to start the claiming process with the assumption that your case COULD end up in court and this cannot be treated as a "get rich quick" scheme.

The next stage for you is to wait to hear from the court who could send you an Allocation Questionaire (AQ) {there's lots of information on this site about it} or, as in my case, the court might decide not to send one; in which case you will be informed when your court date is and given a period of time (14 days) in which you need to prepare your "court bundle" - all the documents you will be using to support your claim in court {again, there is lots of help here on preparing your bundle from start to finish}. You are advised to start preparing your bundle now - you need 3 copies of everything - one for yourself, one for the court, one for the bank; organising all the paperwork, numbering and indexing it to make it easy to read, presentable and professional takes time and it is better to get it started rather than trying to get it done and sent off in a panic before the deadline...

Keep the faith; the bank does not want to go to court; just do your bit and they'll have no choice to give you what is rightfully yours.

I have also found that when trying to print out a copy of the spreadsheet - it comes out blank - there is nothing on it??!

proforma defence received from Abbey National - that microfiched data is "not a relevant filing system" under the Data Protection Act. They also claim no liability for unfair bank charges, although I have not yet made that claim!

	Bank Charges You should have started your claim for your bank charges by now. Don't wait. You should send your bank a Subject Acess Request asking for all personal data they hold on you - not just statements. You should calculate all of your bank charges and related interest as far back as 1995. You should send your bank a demand for a refund giving them 7 days. You should commence your legal action adding 8% statutory interest. If you wait for the outcome of the test case, you may not be able to claim like this. you may not be able to claim interest. You may only be offered the difference between the charge and the OFT "fair charge". The repayment scheme will try to limit you to refinds from 2001 only. A repayment scheme will not deal with any bank charges related defaults on the credit register whereas in a court action you can ask for these to be removed and to be compensated for the damage caused to you and your family by them. You should also write to the bank and to the CRA and put all charges related credit entries in disupte and warn them that you will want them removed from the Register when the test case is over. Warn them also that you are likely to be seeking compensation for these wrongful data entries. Full and final settlement Have you previously accepted a partial repayment of your bank charges in full settlement? You will still be able to claim the rest of your money back after the Test case is decided. Get all your information back to 1995 and put in your claim now.

	Are you letting your bank keep your money Are you giving away thousands of pounds?? Many people aren't claiming all of the money they are entitled to when they make their bank charges claims. You have been forced to pay unfair bank charges. Have you forgotten that your bank has charged you inteest on those charges? If you are overdrawn and the bank owes you charges - then your overdraft is made up of charges - money which you bank owes you. Yet you are paying interest to the bank - on your own money!!! Just a heads up!! I am due to attend court 0n the 20th of July. (No sight of Abbey withdrawing at this stage)I have got all my bundles ready, however I did not recieved any directions for the courts asking for any of this. More so I was not required to complete a Allocation Questionaire.
