Question Abbey vs Plastic-Punk.NEED SOME ADVICE!

Hi Everybody!

Thanks a lot for this wonderful forum.
My problem with the Abbey is:

I already received all my statements and my claim is only for £260+ interest. I already sent a request for refund and already received letter telling me to forget it and change the bank if I am not happy. But The day after I received a letter from Abbey I also received a bank statement showing that hooray! I am again overdrawn by £1.18, which is an interest applied, when I was overdrawn before. Therefore abbey is going to charge me another £20. Shall I pay this £20 and claim them in my court claim. And then send them another 14 days court notice?

Or what else shall I do. I am a bit confused.

When I went overdrawn in February by £83. I went into bank and asked a cashier how much did I own a bank including charges (so I could clear the balance and close the account) and she said £260.39 but never mentioned this £1.18. So this is not really my fault.

Also the account is in jointed names, but the reply from Abbey was only addressed to me. Should I complain? My husband did sign all the letters.

I hope that’s not too much and Thanks again.

PS: I sent all the letters using templates from the library.

If you hven't claimed in court then you can change the amount to inclue the extra charges then.

Its up to you if you pay it or not, either way they are going to take from the account it aren't they?

I wouldnt owrry the letter was not sent to both of you as long as one of you is named, with joint accounts either person can claim, it doesnt have to be both of you!

I wouldn't pay them any more, but you should certainly add it to the claim. If you have closed the account they should deduct the balance out of the payment when they settle.

If you have already sent them the Letter Before Action, then just go on to the court claim - they can hardly say that they didn't know about the extra amount since it's them that have added it. If you have just sent the prelim, then go to the LBA.

the pending debit interest of £1.18 may not have been showing on the charges screen at that time when you went in, and they do give you about a months notice before, so that will be their argument on that one, so be prepared! Give them hell, and just to let you know that doesn't matter what the cashiers tell you officially. Secretly they wish you the best of luck.
