Default Spotnot v Abbey

Well here I am, inspired by everyone on this forum. Am somewhat daunted by it all though, but the determination shown by everyone here will hopefully rub off on me and keep me strong!!

I have two Abbey accounts and have printed off two SARs ready to send first thing tomorrow both with £10 cheques (can't have them complaining about not receiving the right fees!).

Hi Spot, you only need one S.A.R - (Subject Access Request) and one lot of £10 as the information is held on one person, however, in your SAR you need to make sure that you list both accounts, sounds like you know what you are doing so good luck and welcome

Hi all, am now in the process of claiming. Is the time limit for the S.A.R - (Subject Access Request) 40 working days ie 8 weeks or 40 days ie 5 weeks and 5 days?

Excellent! Thanks for that! At first I was really daunted at the prospect of claiming these charges but after reading the posts on here I am now more confident and feel that we all have the backing of a mighty fine website!!

Incidently, I am an accountant and I directed one of my clients to this website today. The first of many!!

Well, received a letter from Pam Speed yesterday asking for £10 to retrieve the statements on microfiche and until this is received she will not process my request any further.

Damn cheek!! I've already sent £10 with the original S.A.R - (Subject Access Request). Have the cheque number etc, so what do I do now?

Do I write back stating "well actually you already have had my tenner" or do I just leave it and wait til the 40 days are up.

Incidently the cheque hasn't been cashed yet. But I did send it !!!!

Hello Spot

It might just be wise to send them a reply to that letter stating that their microfiche system IS relevant under the Data Protection Act (refer them to the report by the Info Commissioner issued a couple of weeks ago after they had visited shABBEY to investigate their microfiche system, a copy of which can be found at the top of the shABBEY forum).

Also state that you have sent them payment with your original S.A.R - (Subject Access Request) letter, with the cheque number and date you sent it, and that they have 'x' amount of days left to get the information you requested under the SAR, 'x' being the days left to which the 40 days are up.

Well I eventually got all my statements from both accounts. Twice!! Mind you I had to ring Sheena Small in Data protection first!! Have to say that she is extremely helpful. According to Sheena, all new S.A.R - (Subject Access Request) are being sent the entire six years, but if you sent a S.A.R - (Subject Access Request) in before the Information Commissioner decision, then these statements are in a backlog and may take time to clear. The Data protection team have to report to the Information Commisioner that they are now fully complying with the SAR and that all requests (old and new) are being dealt with within the 40 days.

However, if you are still having problems getting your statements, I would call Sheena. Her number is 01908 344061
