Default Hi - looking to send Data Protection Act. Send £10 cheque?

Hi everyone its great to see your doing this - your helping so many people out against the nasty corporate giant.

About time the banks got a taste of their own medicine. Even if I dont receive anything its good to see that the banks are loosing out on their little profit making scheme thats making people ill with worry and stress. Little bit about my problem:-

Started about 6months ago when Abbey dropped my overdraft from £1500 to £1000 (they claimed I recieved letters but I did not), I carried on spending as normal aswell as direct debits going through as usual. I then received numerous letters of things not going through, on top of that I bought about 15 things at once from EBay and paid via PayPal some were as little as £2 but I had to pay £30 for each one. All in all at that time I had about £400 of fines just because I wasnt informed.

I rang up and they said they would put it up to 1500 and incremently take it down £100 a month. Nice of them eh? NOT REALLY! Soon as the overdraft went up to 1500 they used the extra £500 they had just put on my overdraft to pay for the fines that I incured when they dropped my overdraft.

Over the next few months, with the odd £30 fine I somehow managed to bring it down to £1000. And this is where the next knockout punch was recieved, I had one or two payments declined and from this I was charged fine for this, it was repeatadlely declined in the space of a few days and extra fines were incurred. Now at the moment I`m in Catch22 as I have another £380 of fines to pay on the 11th of this month and DO NOT have enough money in the bank to pay it, so then.....more fines.....

All in all I think it must be at least over £1500 easily.

Anyone lend me 32p for a stamp to send the letter? hehe

PS. To ask for your 6year statement do you send a cheque/postal order/cash? How long does it usually take to receive a response?

PPS. Should I transfer direct debits and wages into a mothballed account with another bank I have and use that as my main one from now on? As they will surely close my Abbey account? But will they close it if I am near the maximum on my £1000 overdraft? And most importantly also refuse to pay the money Abbey is demanding in outstanding fines? And request nullification of these in my Preliminary Approach for Refund of Charges letter?

I`l be more than happy to give a massive donation as its the least anyone can do for the time you people are taking to give others a hand.

Hello and welcome. It's worth taking a few hours to read the FAQ's and browse the forums.

The address you have will be OK for a Data Protection Act request. The DPA dept address is in a sticky topic at the top of the forum. That's where I sent mine and got a quick response.

Always send the £10. If you don't they can leave it until day 39 and say "we want £10". If you send the money then the 40 days can start ticking when you send the letter. A cheque or PO for £10 to Abbey will be fine.

Abbey (Charges on 3 accounts and default on my credit record) - Data Protection Act letter sent 30/03/06 - 40 days limit is 9th May - Recieved DPA printouts 05/04/06 with microfiche "fob off" letter. <p>Barclaycard (Charges on 1 account and default on my credit record) - DPA letter sent 03/04/06 - 40 days limit is 13th May - Recieved some statements 08/04/06 along with DPA printout and a microfiche "fob off" letter. Claim for £340 sent 11/04/06

Thanks for the super quick response its appreciated. My bad at not looking at FAQ just browsing after that post and answered a few questions. I`m going to goto the post office now and get the postal order.

Just add - would people recommend that I take all my current money out of the Abbey account and put it into my NatWest and move direct debits and my wages there too? As Abbey is asking for another £380 and its all fines so I`m not prepared to pay them and will tell them in my 2nd letter that I`m not willing to talk about this till after we have sorted out the fines that I`m owed?

Do you know how much in total you have been charged over the last 6 years?

Also, I would suggest that you DO use your old account again - leave the Abbey one, but only if the charges are more than the outstanding OD (for the moment).

...also, send the Data Protection Act request recorded.

The Royal Mail seem to dislike banks - they are losing a lot of letters that people post to banks/building socs./cc companies recently.

Thanks - Just sent the Data Protection Act recorded delivery with a £10 postal order, put it straight in the envelope and didnt click on till it was posted that I need to sign it. What an idiot. Think they will return it?

Hi Dave - my overdraft current balance is at -£900 of a maximum overdraft of £1000 and they are asking for £380 in unauthorised overdraft fines. I dont think I should give them the money if what they are asking for is illegal. Am I right?
