Arrow Me V Abbey National PLC

Hi All

I have being doing lots of reading and have now decided to take the plunge

So here it is.... I've sent off my S.A.R - (Subject Access Request) letter by recorded delivery today and will keep you all posted.

BTW Would it hurt to just request the statements in a branch on top of the S.A.R - (Subject Access Request) so that I can get the info i need quicker ?

note; My Overdraft is soon to be included in a CCCS - DMP, although the account still seems active at the moment. Hopefully this will not effect my claim ??

Interestingly one of the condition of the DMP is that you activly pursue money owing to you.

Thats very interesting, a question that often comes up is if i am in an IVA/DMP can i claim?

The condition to pursue money owing to you is that written somewhere or was it a verbal instruction?

It was stated when you setup a buget paln that creditors expect you to claim all the money owing to you e.g. tax credits, benefits ect. so I assume that includes illegal bank charges

I phoned cccs and they advised me to seek external advice regarding bank charges

Received A Standard MANINT Letter today

Acknowledging my letter and £10 received, promisings last 14 months within 5-7 days and rest to follow under separate cover (no timescale ??)

The letter also states they are unable to help with 'Manual Interventions' as they do not keep records of this

I'm in the same position as you - I'm going to be making claims against a my bank & credit cards which are also to be included in a DMP with CCCS - I'm going to call my advisor & ask if I should still make payments as these accounts are effectively 'in-dispute' I've done lots of reading on the forums & from what I've seen so far it states that creditors can not enforce payment where an account is in dispute ... dunno if this is the same if a DMP is in place??

I'll be interested if anyone has a definate answer on this as my old bank a/c they actually owe me more than I owe them so am begrudged to start paying it back!

Received 13 months of statements today, each in an individual cost saving envelope !!

Interesting how the charges summary is now missing off the front of the duplicates (thanks abbey )

Done my initial workings with the excel spreadsheet with the 29 statement that I now have in my possession ..... Scary how they add up !!

Just thought I'd let you know - I spoke to an advisor at CCCS today regarding whether my payments should include the accounts which are technically in query due to these charges - she advised me to include them & pay for now as the money I want back is not guaranteed .... I see her point really

I haven't started highlighting on my statements yet (luckily I'm a bit of a hoarder & still have my original copies) Think mine will be 'scary' too!! :o

Got my copies of the microfiches today, really poor quality with some digits missing, also still got 3 months missing between the microfiche and statements.

Spent a few hours linking the microfiche statements in to give a running balance (which is missing on the microfiche !!) so that I can claim the Interest back over the years........ (very time consuming)

Finished the Complex bank statement now and Mr Abbey has been getting rich off me some 6k over 6 years.

Will probably work out an average for the missing months and press ahead.

Need Sleep now !!

Finally got aroundtuit and posted my pre-lim letter today, think I was hoping it would happen by itself one day

I averaged the "account balance at interest date" based on the interest charged for five or six months, hope thats ok

I think uv done all you can really with the info uv been supplied ... I wouldn't worry about it too much - it's up to the banks to correct your workings if they are wrong - u just have to show uv done as much as you can with the resources you have ... lets face it none of us could ever be as accurate as the banks anyway ... well done & good luck

Sent my LBA off today, hope this is all text book stuff

Received a standard letter of acknowledgement of my "complaint" and a procedures leaflet ? Which did not seem to acknowledge my request for repayment at all

Hi and well done, dont forget that when you get your claim allocated to your local court with a claim reference number, you should forward your spreadsheet to them, clearly marked with all your details plus claim reference number
