Default where do i start

i have an account which has a 800 ponud over draft now and again i have gone over that sometime a pound or more i.m going to have terrible charges this month and have in the past i have set up another account so i will get all my money paid in to that account so what do i do next its all abit scary and i want to no all my facts which i have read an awful lot but what if they demand all the overdraft back straight away. also we have had advice from the c a b why have they not advised any thing like this as he doing good things many thanks if any can help

Hi

Welcome to the forum, the more people we have on board the more strength we have to fight these unlawful charges. I am sure you have a great many questions, and would therefore advise that you to have a look at the FAQ's:

In the same section you will also find a step-by-step guide which will help you through the process. The most important thing to do though, is to spend time looking through the forum at the experiences of others.

It is advisable to spend at least two days doing this - I understand that you are in a hurry to get your money back - but time spent now in learning and understanding the process will benefit you later. It could also save you from making costly mistakes.

All the best with your claim. Please keep us informed of your progress, and remember that we are all in this together. If you meet any problems, or have questions that are not answered elsewhere (and most have been), please post them to the forum.

i think i will start buy asking for a breakdown of all the charges i have had in the last 5 or 6 years i take it buy using the standard letter and see what happens from there thank you for you reply i may do it over the phone whats best do you think

Be warned that Abbey will use every delaying tactic they can. The only way you can ensure that they keep to a reasonable timescale is if you use the Data Protection Act template and, most importantly, send the £10 fee.

I would strongly reiterate my previous post. If you don't follow the step-by-step guide you will find that the bank will obstruct your claim at every stage.

If you don't put the Data Protection Act in writing, and send the £10 fee, Abbey have proved that they will ignore it.

This is a legal process, and could end up in court - because of this it is vital that you fully understand the process, and the legal arguments you may have to put forward.
