Hi. I have copied the perliminary letter and saved on my computer. I've downloaded a statement from my bank for the whole period required. (I have only been with them a year!). So here goes. I'm going to rock that bank with the help og the Consumer Action Group.
The group has certainly given me the confidence to stand and be counted!

Hi Everyone. I first started my claim back in Sept and made the mistake of
leaving it for a few months and finally sent the letter and caluculation as instructed in November. I received two replies from Abbey the latter advising that they had carried out a full investigation and that they "are satisfied there charges do not contravene the Unfair Terms in Consumer Contracts Regulations 1999."

This was 12th December and with Christmas etc I have only just got back to the issue and wonder if now is too late to do anything even if I could.

Should I carry on - start again - or forget it??

I would like to be a winner rather than a giver upper!

Hi Julie

I would suggest you now send one further letter - the same as the LBA in the library referring to your previous letters and that you have not had a satifactory response, and you will file in court within 7 days.

And start orgainising your paperwork ready for court

Hi Karnevil. Many thanks for the advice. Will do straight away. Also since my first contact and spreadsheet of charges, Abbey have made further charges to my account. One for being 0.49p overdrawn because they had taken charges! Should I include an updated list of charges or leave as before?
There is quite a sum since. Thanks.

Oh and would Consumer Action like me to scan my letters from Abbey and post them somewhere on the site? as examples?

Sent my 2nd letter giving 7 days and . . . . . yes you guessed it! They didn't even have the courtesy to reply!

So I guess the next stage is court papers. Where do I look for these??? I am starting to panic now. But I guess that is what they want!

if you use MCOL it will assign the case to your local court and if you have had any further charges, then add them all on

Can anyone help me with the court fee costs?? I thought these were approx £30.00, but when I have calculated the cost on the MCOL website for £505.30 of charges the cost has come up £80?
