Default Taking on the Shabby on behalf of my son

Hello everyone,

Just directed here from Martin Lewis's MSE site. My son lived like a king for one weekend in May and as a consequence couldn't make his direct debits. As a result he was charged £315 in charges.

He is currently on an apprenticeship with a company that is paying way below the minimum wage - he gets £400 per month at the moment. He recieved no offer of financial counselling when he went to see the bank but instead was offered a credit card - i ask ya

At 18 he should be responsible for his own oversights but........

He has all of his statements - does anyone have an address to send the initial letter?

Hope he really enjoyed that weekend then !

Send the first letter to his local branch, or the Milton Keynes office. Send it registered post so you have proof of receipt. Don't expect too much, get the next letter ready to send in 14 days

Just received bog standard and badly photocopied 'I am sorry that you have been so unhappy' letter signed by Marc Winder.

I've been given the fob off 'one of our team will look into your complaint' drival and we'll get back to you in 4 weeks.

Should I be doing something in the meantime?

Send the LBA 14 days after the date of your prelim letter. Don't wait for them to get back to you.

Here we go, 12 days after sending my prelim letter on behalf of my son for £315 he received a letter offering £158 as a GOGW. They went on to quote some tish and tosh from the OFT dated 5 April 2006 relating to credit card charges only and not bank charges. They went on to claim that a specific team manually input the data for having insufficient funds blah blah blah.

Am I still right to submit the LBA and is there a template that rejects initial offers? Additionally, would it be a good idea to back-up my son's LBA with a personal letter from myself saying how disgusted I am that they charged £315 of my sons £400 monthly apprenticeship wage and that he received no financial counselling at the expense of him being offfered a CREDIT CARD!!!!

Anyone's advice would be appreciated on the way forward

Send the LBA and amend the 1st paragraph:

Thank you for your letter dated xx/xx/xx and settlement offer of £ XXX
I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder.

It's now almost 4 weeks since I sent the LBA following their GOGW of £175 for the £315 debt. I have given them plenty of time to reply I will now puruse through the claim courts. for the balance of £140 plus interest charged of £4.06

Could someone advise on where to go next with this

Following the serving of the money claim court notice I recieved a letter from Abbey asking for the schedule of charges and interest that I was unable to submit with the online money claim.

They have already received 2 schedules with the prelim and the LBA respectively.

Could someone please advise me on my next course of action
