Hi

Im new to this forum and would like some help and advise.

Ive had lots of charges with Abbey and Halifax, so after reading this site, i sent abbey a first letter, no reply, so i sent them a second letter 14 days after.

I just went to the bank today and got a statement, on there, it shows i was refunded £170.00 worth of charges yesterday. Im claiming for £454.00, im surprised ive not had a letter from them to confirm this, it was just by chance i went in today to get a statement.

I would like to know what i should do now??? I dont want to accept this, so should i ring them or write too them???? Please help. Is there a template for rejecting an offer???

You could keep the money and write to them saying 'thank you for the money but I'm still waiting for the rest of it'. I don't think you need to reject the payment already made.

Yes I would write and say

As you will be aware I will be sumitting my claim in the courts for a refund of charges debited from my account from DATE to DATE totalling £4XX.XX. At this point additional interest will be added to my claim pursuant to section 69 County Courts Act, and court costs will also be added.

In order to avoid this course of action I ask that your settle my claim in full, a total of £4XX.XX, to be credited to my account prior to 4pm on XX/XX/XXXX (th date your LBA runs out).

Alternatively I will pursue my claim in the courts for the full amount.

Change it about however you like but I think that should cover it. You are saying you acknowledge the £170 but do not know what it applies to, so will carry on with your claim for the full amount, unless they tell you what they've refunded you, or refund the full amount to your account.

Default Over the LBA Date

Hi

Need some help please....

Ive made a bit of a boo boo.

I sent the LBA on 10/08/06 saying i will be starting the court action on 25/08/06, however i failed o do it....ive had ome personal problems at home and totally forgot about starting the claim.

Please help wot do i do???

sent mine on 13/08/06, and Abbey recieved on 14/08/06. Issued claim on 30/08/06 so couple of days over 14 day period but that was to their advantage and they have not contacted me any way. Just go ahead and issue your claim.
