I don't think so - the banks "regulate" themselves, so will investigate themselves too - this is my understanding of it; and when they investigate themselves and come to the conclusion that it is you that is wrong not them - the ombudsman is supposed to take over.

Sadly, when it comes to T&C's the ombusdman will not get involved.

Quite right really - it's not a legal body, merely a mediator.

I don't know what they're procedures might be. Frankly I don't imagine that they have that kind of scrupulous legalit aporach. not that they are unscrupulous - just that it doesn't even occur to them that this might be a desirable approach.

Received a letter yesterday saying they'll pay back my £110, providing I sign a letter essentially stating it was all my fault and they are very nice giving me my money back, etc ,etc. How do I respond to that without accepting liability?

P.S. They also stated they were "PENALTY CHARGES"

Sent a reply to their letter this morning - plain and simple - accepting the money and accepting as settlement on this occasion - I did not sign the letter they requested me to sign trying to apportion blame to me. Now I just wait and see if they return the money owed.

Default Comparison of Bank Statements

Just for comparison I wonder if any of you could tell me, in particular to uncleared funds, if you go overdrawn is it shown on your bank statement as a negative balance or specified as overdrawn...or does your statement still show you as being in credit. Any replies please state your Bank.

Hmm really sure what you mean but on my NatWest Statement is will say for example:

£1.25OD

That means £1.25 OverDrawn.

In RBS it depends on what statements you mean.
Say you're £100 overdrawn:
Proper statements (ie those sent out in the post) say £100.00 DR (DR = overdrawn by the way)
If you asked for a mini-statement at the in branch it says £100.00 - (ie £100 followed by a minus symbol)

Just received my closing balance this morning...but without the money that was owing to me for the alleged OD charges. How long does it normally take once an online moneyclaim is made for the court date to be given.....I don't want it to conflict with my holiday?
