Default 2 Business Accounts`

hi there - have finally taken the plunge and decided to try and get back charges. just a quick query - i have 2 business accounts with abbey a basic- ie no overdraft and one with an overdraft...do i therefore have to send 2 Data Protection Act letters or can they come under one umbrella?

When you say 'Business Account' - do you mean you're a sole trader or a limited company?

Limited Companies can't make Data Protection Act requests so just work out the charges from bank statements.

In that case yes just send 1 request and 1 payment. A single request covers you for all information held about you. Just make clear what information you require, and from which accounts.

Default me Versus abbey!

hi there - i have last thur. sent my initial Data Protection Act letter to abbey after spending much time looking at this site . i have got the small claims pack and although it is a daunting prospect i, as is everybody, am fed up now, so fingers crossed they wont start messing about. i will have to proceed slightly differently as i have a business account but overall i am quite excited about challenging them.

btw - you can see a couple of years back on your business online banking if that helps

Hi all, i stumbled onto this website and my jaw dropped with what i was looking at, i have now went to my abbey branch and used the phone there to ask for my statements for the past 6 years and got some guy in some small hut in Bangladesh as usual, so he told me it takes 4-6 weeks to get my statements which i'll wait for, i took his name and the date so lets see. My girlfriend on the other hand is German and so efficent, she has only been with abbey for just over a year and is totally horrified at their excessive charges, she keeps every piece of paper that i would find irrelivant and files them lol, so all her statements she has, so we went through them and in 1 year alone she has been charged just over £600 so we are going to start with her account first and see how we get along, i've dowloaded some letter templates from the site and will set about it over the weekend.

So a question on this matter, my girlfriend has all her statements, do we photocopy and then highlight all the charges on her statements or is there something else i need to do such as some sort of pdf form or something.....

Hi Azda and welcome to shABBEY and the site.

Best place to start is to read all the FAQ's - see link in my sig. You really need to formally request your statements in writing as a subject access request under the Data Protection Act then they must comply within 40 days or you can if need be take them to court. If you have a read through the threads on here you'll see Abbey dont like just giving out the info, and I doubt if you'll get it within 8 weeks based ona telephone request.
Also, start your own thread for your claims and keep us updated and aks any questions in there...helps keep the forums tidy and people wont get confused whos is whos claim.

Hi - take a bit of time to read up first to make sure that you have the facts before going too far ahead. Read the FAQs and template letters then have a good read around here to see how others are getting on. Keep any progress on your own claim or questions that arise in a new thread in the forum for your bank to make it easier for others to follow and advise you. There's a set of links in my sig below that will help you find where all this useful information is. Well done for getting started!

The main difference with a business account is that you can't use the Data Protection Act to get data, as that is specifically for personal information.

azda71 - i wouldnt like to advise anything as i am very new also.. would hate to offer incorrect advice. i just read round the entire site and posted a few q&a's before i was ready to go further.. i would def do that and poss post on the site rather than my thread as it may not get seen... good luck though!

My request was for a complete list of transactions and charges relating to my account since xx/xx/xx – in short, a list of charges with dates and amounts – alternatively, a complete set of account statements for that period will be acceptable. This should be retrievable from your accounting systems, and easy for you to produce. I will accept a computer print out of these transactions.
I am aware that you have been willing and able to provide other customers with a print-out of transaction information covering this period – and am ready to bring this to the attention of the Information Commissioner should it prove necessary. I would also draw your attention to Smith v Lloyds TSB Bank plc (2005) EWHC 246 (Ch).

This letter has been sent by first class recorded delivery, and therefore should have reached you by xx/xx/xx (insert next working day after posting) – as you will be aware, as of this date you have just XX days (insert days remaining since they received your original request) in which to comply with my request. As stated above, a complete set of account statements for the period in question will be acceptable; however, I expect this to be provided within the time period for Data Protection Act compliance.

Should there be any further attempts to delay compliance, I will be left with no alternative but to commence a County Court action under section 7, and section 15(2) of the Data Protection Act 1998, and in due course, escalate this matter into an official complaint to the Information Commissioner and the FSA.

karne thanks for the reply - i did have a seperate thread but it seemed to have got lost and didnt appear as a current item...?
i got 14months worth of statements throught the post today - my poor postman must have cursed me!
i am sending the microfiche letter tomorrow recorded so they will get that on friday.
oh, i only got statements for one account although im claiming for two.

you'll prob get a letter asking for another £10 which you can write back to saying the Data Protection Act covers you as a person not as an account number.
