| | Basic Account Customer | 2 Business Accounts` hi there - have finally taken the plunge and decided to try and get back charges. just a quick query - i have 2 business accounts with abbey a basic- ie no overdraft and one with an overdraft...do i therefore have to send 2 Data Protection Act letters or can they come under one umbrella?

Limited Companies can't make Data Protection Act requests so just work out the charges from bank statements.

btw - you can see a couple of years back on your business online banking if that helps

| | Basic Account Customer | Re: me versus abbey Hi all, i stumbled onto this website and my jaw dropped with what i was looking at, i have now went to my abbey branch and used the phone there to ask for my statements for the past 6 years and got some guy in some small hut in Bangladesh as usual, so he told me it takes 4-6 weeks to get my statements which i'll wait for, i took his name and the date so lets see. My girlfriend on the other hand is German and so efficent, she has only been with abbey for just over a year and is totally horrified at their excessive charges, she keeps every piece of paper that i would find irrelivant and files them lol, so all her statements she has, so we went through them and in 1 year alone she has been charged just over £600 so we are going to start with her account first and see how we get along, i've dowloaded some letter templates from the site and will set about it over the weekend.
So a question on this matter, my girlfriend has all her statements, do we photocopy and then highlight all the charges on her statements or is there something else i need to do such as some sort of pdf form or something.....

Read the FAQs and template letters then have a good read around here to see how others are getting on. Keep any progress on your own claim or questions that arise in a new thread in the forum for your bank to make it easier for others to follow and advise you. There's a set of links in my sig below that will help you find where all this useful information is. Well done for getting started!
The main difference with a business account is that you can't use the Data Protection Act to get data, as that is specifically for personal information.

1. i am claiming as a sole trader on 2 business accounts i sent the Data Protection Act letter - Data Protection Act 1998 subject access request - which i am now thinking was incorrect - could someone clarify this for me please - also i gather that this now means that they have basically rejected my Data Protection Act request.
2.
do i now send the letter as in alanfromderby has on his link: I am in receipt of your letter dated xx/xx/xx, outlining that you could only provide me with printouts covering recent transactions on my account, because any earlier information has been archived onto microfiche. (*I also acknowledge receipt of the information you forwarded.) *assuming they have sent you some. My request was for a complete list of transactions and charges relating to my account since xx/xx/xx in short, a list of charges with dates and amounts alternatively, a complete set of account statements for that period will be acceptable. This should be retrievable from your accounting systems, and easy for you to produce. I will accept a computer print out of these transactions. I am aware that you have been willing and able to provide other customers with a print-out of transaction information covering this period and am ready to bring this to the attention of the Information Commissioner should it prove necessary. I would also draw your attention to Smith v Lloyds TSB Bank plc (2005) EWHC 246 (Ch). This letter has been sent by first class recorded delivery, and therefore should have reached you by xx/xx/xx (insert next working day after posting) as you will be aware, as of this date you have just XX days (insert days remaining since they received your original request) in which to comply with my request. As stated above, a complete set of account statements for the period in question will be acceptable; however, I expect this to be provided within the time period for Data Protection Act compliance. Should there be any further attempts to delay compliance, I will be left with no alternative but to commence a County Court action under section 7, and section 15(2) of the Data Protection Act 1998, and in due course, escalate this matter into an official complaint to the Information Commissioner and the FSA.
will this cover me being bus. bank account?

i got 14months worth of statements throught the post today - my poor postman must have cursed me!
i am sending the microfiche letter tomorrow recorded so they will get that on friday.
oh, i only got statements for one account although im claiming for two. initial Data Protection Act letter received by abbey 4th aug
1st reply letter received 14th aug received 14 months worth statements 16/8/06 sent recorded letter 17/8/06 (alanfromderby re microfiche argument)
