Red face i want out of the shabbey habit!

Hullo fellow crusaders!!

I begin my cliam against Abbey on 9th June--Sent the Data Protection Act request giving 40days,
As per Abbey style I received the microfiche argument letter with 12mths worth of statements.
Sent 2nd letter for Data Protection Act on 19th June giving them until 18th July to supply details--Surprisingly enough I didnt get them , just the usual fob off about microfiche info not being under the Data Protection Act etc etc.On 25th July I sent the lba giving them 7days to respond-well today is the seventh day and nada!!
I am itching to get going on this but have no idea how much my claim could come too.
I know I should submit an estimated claim but I am worried about it being too high and this jeopardising my ( and other peoples)claim.
Please help me!!

Hi lil smell

You have got your 12 months worth of info havent you, how much does that come to ? To work out an estimate to send your prelim letter bascially you just multiply by 6. You just have to show a court that you have based your estimate on something.

In your prelim letter for refund mention that you have estimated the amount because they haven't complied with your Data Protection Act request, which you are claiming for non compliance in the courts.

If its too high its really up to the bank to give you your info. If its too low you are relying on the bank saying so, and do you think they will......

However if you claim for the Data Protection Act noncompliance at the same time, they will give you your statements, probably before you are ready to file your estimated claim so you can adapt the figure then. If they dont give them to you till after you have filed - you can adjust the figure on your claim.

Thanks for that--I estimate the figure to be near £6000 then(before interest)-Ill check tonight and do my prelim letter how you suggest.

Hey thanks, I still have many more battles ahead so I'll be about a while yet.

Do your prelim and LBA letters at 6k, then you can decide what to do (ie. fast track or split it for small claims) when it comes to filing with the courts.

Its good to know that you will be around cos I think I might need you help !!
Im tryng to complete the N1 form for Data Protection Act non-compliance.
Dont know how to estimate the cost of damages and does the claim includes any issues under the Human Rights act?
i feel soooo barbie right now but I really want to do this right first time!

Don't feel barbie, I was well stuck, and thank goodness my statements turnined up yesterday so I didnt need to do i t.

BAsically no no humans rights issues, and estimate damages about £30 - which is basically your time, cost of letters, printer ink etc etc.

Any probs have a look through LOST IN PARADISE's thread (in shABBEY). lots of help on there.
