Smile Summary of charges not sure what to claim for

Hello all

I have just recived my summary of bank charges form abby
but I am not sure on what i can claim for I paid the Ten pounds fee Here is a list of charges

Total Cleard Transaction Charges = - 180.00 pounds
Total Unpaid Direct Debit Charges = -137.00 pounds
Unauthorised overdraft fee = - 60.00 pounds
Total Cleared Transaction Refunds 30.00 pounds

I dont know what to claim for I understand that I have to calc intrest but can any one advice me what charges above i can claim for

I got a summary of fees charged from Barclays when I sent off my Subject Access Request. I came on here and got told to tell them that wasn't good enough as there is not enough information there to lodge action. I found a template on here 0- I'm not good with linking in here so sure someone will come along soon with links - but it was to do with not complying adequately to my Subject Access Request and that the clock is still ticking. Sorry I can't be any more help than that. Good luck with Abbey x

You can claim all of those you have stated - except the refund of course!

I take it that you have just added them all up, and thats not what shabbey sent you? And is that 6 years worth?

Thanks for your reply The charges above are what abbey sent me the charges were just cpoied off the paper so all i need to do now is add the intrest up not sure if i can claim hardship because i am in rent areas too

From what I understand, and I could be wrong so get someone to confirm this, but if you intend to make a claim, you need the dates that each of these charges were applied as well as the fact that they were. That is why I ended up sending my bank a letter telling them what they had sent wasn't good enough. Like you, my bank sent me a list saying the year it was associated with and the total for that year for each type of charge. Apparently that isn't good enough for a case, but like I said have it double confirmed.

You are right thekat, you should be provided with a detailed list of the date and type of each charge, in order to accurately calculate stat interest for each one.

So, definately send them the non-compliance letter asap - they bloody well know what they have to do, just being slippery shoddy shabbey as usual. (rant over) xx

He guys I have spoken to abbey by telephone they advised me that They do not have the dates that would be on the statements and thats all the info the could provide me not sure what i can do now

Really???? Utter ballhooks!

I take it you sent the non-compliance letter?

Generally, shabbey apply charges at the end of the month - around the 28th (well, in my case and a few others I know of anyway) - so if you have the months you could work out the claim on that basis, but obviously it is not entirely accurate.

However as they are blatantly stringing you along, I feel an official compaint is in order.

In the immortal words "I'll be back".................... .............

If they have just given you the months rather than the exact dates, use the 15th/16th of each month to calculate s69 8% interest. The difference will only be pennies.

Hi guys i did not send a none compliance letter due to speaking with them on the phone should i send it still also I am still paying a little to this debt each month

guys do you think i should just send a letter asking for charges and no interest as i need to send something soon i need to put this account in dispute with dca as i was paying six pounds too them but stopped paying now they said they will take me to court any ideas

Oh gosh - sorry you haven't had any replies.

So, is this right:

You have not sent the non-compliance letter?
The account has been passed to an external DCA?

The way I see it is that you need to write to shabbey - using the non-compliance template with an addition that they should not have passed your account to a DCA. This needs to be done straight away, with a copy to the DCA headed "Account in Dispute."

Sorry this is a bit short - got visitors coming in a mo, but I promise I will be back tomorrow with more help.

Hi there Thanks for your reply i have not sent them any letters yet could you link me to a non-compliance letter as i cant seam to find one account have been to 2 dca I did pay them a little money 5 pounds pm then stopped not sure if i should start again

Okay, I have just re-read through, and actually I think with the amount of time that has elapsed, sending the non-compliance letter works against you, as it just gives them more stalling time.

I think you should prepare a spreadsheet with the charges they have given you, and use the date suggested by Michael Browne above - 15th or 16th of each month, and send the letter from here:

Preliminary approach for repayment - Consumer Wiki

including your rent arrears and any other financial difficulties you may have, so that you may be considered as a priority case under the hardship criteria.

Hi thanks for your advice I have looked at the letter looks good but i don't think I will be able to get interest and my situation is quite complex regarding hardship as my money has increased a bit now Do you guys think i should start paying these guys again I really don't know for the time being i just need to stop action against this account if they try Thanks
