Default Apex chasing...

Hi all. I have a 1200 pound debt, formerly with abbey, who defaulted me a year or so ago. The amount is mostly made up of bank charges, which i do intend to claim back on but need time to get the S.A.R - (Subject Access Request) off to Abbey.

Apex have been chasing for a while and i fear they are on the verge of court action, against which it is unlikely i will be able to defend. Is there a letter i can send to apex to gain me more time to sort out an S.A.R - (Subject Access Request) and possibly file a claim? I did originally CCA abbey, and I have sent the CCA letter to apex but they did send back a copy of the agreement, and since then I have also read that the CCA is not applicable to overdrafts.

It was a student overdraft. I had money going into the account each month, but when i lost my job they cut off my account without warning and started adding intrest/sending me debt recover letters. This was about three or four years ago.

I had the account for about 3/4 years and over that period paid a huge amount of charges for failed DD's and visa transactions when no money was available.

Any help would be appreciated. I am a student again right now and cannot afford to make payments off this account.
