Question georgie v abbey

help i am new and just started to make a claim against abbey. i have sent the initial letter and they sent the normale response stating i woul dhave to pay more for what i want. i then sent them the second recorded delivery letter asking for a proper response and i am still waiting. What do i do next as now they are getting nasty !!! They have found a 9 year old closed account where i made many attempts to pay but no one could give me a suitbale answer of how to arrange this, and sent it to a collection department demanding all monies in a week or ccj ?? They have put a stop on me transfering monies between my abbey account without me going into the bank and not over phone as i have done so many times before the letters
Finally they are putting a block on my account if they have to return a direct debit!!!
please help what do i do after the second data protection request letter

Hi georgie and welcome to the site,

Read as many posts as you can on this site as it will give you lots of answers as well as questions. I have just sent my second Data Protection Act letter and will now take action against them in the small claims court if they do not comply. Don't worry it is just shabby putting pressure on you, pretty sure as soon as you put in a DPA request to them now, they know you are after your charges back. Stick at it and good luck.

Regards bish.

Hi Georgie

Are you saying they have dragged up this 9 year old account since you sent the 1st letter to them ?

Have you contacted them about it - if not DON'T...... until we look into it a bit more.

give us a few more details (general amount, when did they send to collection dept ? , when did you last contact them about it ? etc)

Then we'll try and help......

yes this was a bank account that was agreed to be closed to allow me time to pay the charges on it as i was overdraw over my overdraft and with problems at work and money being cut i could not afford to pay charges, so the citizen advice bureau agreed with abbey to allow me to have an instant plus account.i contacted them and was making payment of £50 manually over the phone each month, however each month it would be moved from department and get harder and harder for someone to take this from me. i contacted the collection group working on behalf of abbey and they were given the account 63days ago. Abbey stated they could not find me even tho i have 2 other account registered to my address ??Now abbey want the outstandgin amount in full or baliffs visit ???i have haad no previous letters from abbey, i moved address 4 yrs ago and abbey were infmd and no other contact re this old 9yr account.general amount is £1200 as no contact was made from them at all re this.it was not an instant plus account.

bump...just summarised the basics on this post.

Requested Data Protection Act info from bank. Abbey started chasing 9 year old account.

this was a bank account - - - closed (when was it closed ? ) to allow time to pay the charges on it

making payment of £50 manually over the phone each month ( okay until when ? when did you stop paying ?)

i contacted the collection group ( whats the name of the DCA ) working on behalf of abbey and they were given the account 63 days ago

Abbey stated they could not find me even tho i have 2 other account registered to my address i have haad no previous letters from abbey, i moved address 4 yrs ago and abbey were informed.

Now abbey want the outstanding amount in full or baliffs visit.

Georgie

I know this will sound harsh but go read the FAQs which tells you more or less the process for making a claim, what happens when they send a microfiche leter etc.

Im new too but with an evening or twos reading and research you will be much more confident and have a good idea of the porcess, what the banks do to try to cause you greif, in fact the whole 9 yards.

When youve done that come back and ask for the details which arent filled in.

HTh

Glenn

PS a 9 year old account? as asked above when was it closed?

Hiya, Yes the microfiche is a general stalling letter - how many statements do you have 14 months ?

If your 14 months charges are #3700 thats quite a lot. You could claim for this amount now and the previous years later after this claim is settled and you have received the statements.

This amount will also cover anything you owe to Abbey for the old account.

What is the name of the DCA who is chasing you for this payment ?

Well it should be statute barred... I'll have a look about now for some info for you.

Whats happened with the DCA - has abbey asked you about this or is it just 1st Credit chasing you for payment ????

Do you know if you have a default on your credit records from Abbey regarding this debt ?

okay - dont talk to abbey about it, and dont talk to the DCA.

It sounds to me as if they have sold on your debt with them to this DCA. They may have bought it for a small percentage of the value of the debt.

If your last payment was made in 1997 then the debt should be statute barred. What communications have you had with the DCA or is it you have just received a threatening letter from them ?

Oh - thats statute barred out the window I think.

I'll try and get some one to come help you.

I think you can send them a CCA letter asking for a true copy of your original signed agreement.... but I'll try and find out more info.
