Hi,
I first heard about all this 5/6/06, promptly found this site and posted my data protection request 8/6/06. Got the microfiche response 15/6/06 along with 14 months statements totalling £410 of charges. Didnt know what to do so gave them some time, until i saw alanfromderbys template, so i posted my response 12/7/06 recorded delivery.
I have a £1500 overdraught and my mortgage with them (can any of these be effected?)
I will be immigrating next April and would like this to be resolved by then. Does this sound realistic?

Hi and welcome to the site.

Your overdraft might be affected but I doubt very much that your mortgage will be.

But by the sounds of it your charges are going to cover your overdraft anyway, so it shouldn't be too much of a problem.

As long as you stick to the timeframe you should have your payout within a couple of months after requesting your money.

Just like to add a little story that makes me more determined.
After 3 days in labour my wife gave birth to our son 9/5/04. On the second day of labour , we were at home when i suddenly got alot of letters through the post from people i have direct debits set up with , wanting an explanation as to why i have cancelled.
I was stressed as it was so i had to phone abbey to find out the problem. After several phonecalls and the arrival of the wee one i finally got somewhere. Apparently all my dds were cancelled due to an abbey computer error!
I wasnt pleased to say the least, i didnt need the stress of having to set up the dds again and dealing with incompetent call centre employees. I told abbey i wanted to be compensated for my efforts , stress and phone calls. I came to the calculation of £30 for each cancelled dd, the same as they would. (8 dd x 30= £240) . I thought this reasonable in light of the situation. After talking for days going round in circles i got speaking to someone that was finally amakeing sense until i was given the final word- We can give you £10 for your calls and that is it, we cant give you any more as you cant MAKE A PROFIT ON CANCELLED DDS.
I was advised to aproach the umbudsman.
I told them to shove it with their ten quid and said i would be changing banks , alas i never did.

40 days now up.
Just got letter dated 24th july from Pam Speed a.k.a. Snail Speed.
They are keeping up the microfiche argument. Looks like this is a dead end. I feel like just going up to my local branch and refusing to leave until i get what i am legally entitled to ( could this maybe work?)
My 14 statements show £410, but i think the years before i paid more. But if i estimate more then what im entitled to what happens?
Ready to start the ball rolling. What next?

I would try going to your local branch and see if they can help, if they can't just put in a reasonable estimates for the missing years, Abbey will either have to prove it or pay your estimated figures.

Don't worry about the estimate. Just keep it realistic, based on the statements you have. Something like 410 divided by 14 gives you an average for 1 month. Multiply this by the number of remaining months. Add on the £410 and this gives an estimated 6 years if that's how far back you are going. Abbey will soon complain if it's overestimated and then they'll have to provide the evidence anyway.

just had to call them.
Basically as i understand it, requests for charges and transactions are covered by the data protection act, requests for statements are not.
They keep saying , however, that the only way they can give me the information is by statement as its the only format they can supply.The girl i was talking to said " i dont know why, but it says down here you wont be getting them for another few months"
I feel like im talking to a brick wall.
Will call them again tomorrow.

Called them again today.
The statements department have promised me my info for the last 5 years will be with me within a week. I said i would give them this one last chance.
Should I?
Twice i was "cut off " while on hold, do you think they would just hang up ?
Really irritating.

Just back from a holiday, no more from abbey.
Downloaded the complaint form to the information comissioner, will start court action too , but how do i start the court action and how much will it cost ?
Should these be done at the same time?
What will get the best response?

Hi, you can start court action by either doing it online with moneyclaim or filing in the N1 and taking it in person to your local court. The costs depend on the amount you are claiming. I havent been in this predicament my self (being a kleptomaniac I have all my statements ) but there are plenty of others who have, have a read around and you should be able to get a few ideas as to how others have tackled this. You can submit a claim with estimated charges on but it costs to get it altered. Some peeps have started court action and then their statements have appeared quite soon after. Some have also taken Abbey to court for not providing the statements so it really is down to what you feel most comfortable with. Good luck with your claim!

Now 2 months and 10 days since they received my request for a list of charges.(I was just now finding time to get the court claim filed)
To my astonishment , today i actually received them.
No court action , just persistant phone calling.(which i did while commuting from work on the handsfree)
My total for 5 years (Scotland) is £1040, which i was a bit surprised at , as my last 14 months was £410.
Anyway now im ready.

received letter from marc winder dated 28/10/06- sorry you are so unhappy that you have felt you must complain, blah blah blah. we are investigating.....blah.
looked at my account today, as total of £280 in charges refunded.
LBA will be sent tomorrow, but should i ignore the 280?

HELP !!
can someone tell me if im to send in my summery of charges the amount im claiming ie, £xxxxxx plus intrest £xxxxx = total £xxxxx based on statements i have.... or if i just put down amount of charges only £xxxx= total claim amount based on the statements i have and then put that i reserve the right to amend the total amount if need be aif they send rest of statements. ...Does that make sense...

received gogw letter today from Justin Harris Senior Resolution Manager (with real ink signature wow).
" having carried out a full investigation, i can assure you the charges do not contravene those regulations and therefore i cannot agree to refund all of them...HOWEVER! as a GOGW, i am happy to refund £400. This includes pending charges of £85 which have not yet left your account".
O so very kind of Mr Harris!
