Default Have started at last.

:o Have today (finally) sent my data request from to Abbey. Judging by other posts in this forum, Abbey will make the process very very difficult and will probably use the microfiche argument with me as well (luckily I have read the relevant letter to send if they do!)

I am still feeling very nervous about this all (especially if they make me close my account an/or make me pay back my substantial overdraft), but hey ho.. I've let them get away with their actions for too long and am willing to make a stand with everyone else (safety in numbers etc!!).

Is the limit for the small claims court £5K? What happens if the info they send shows (as I fear it will) that I have paid more than this in charges? Haven't i been a naughty girl!?!!

Shabby first of all well done so far.
Although Abbey are famed for their antics as I have said many times........they are not above the law and will be taken to task whenever they introduce more staling techniques. The microfiche arguement is not new and has given people time now to challenge this.
Today I got my copy statements from Barclays.......all were pulled from microfiche and they even sent my tenner back.
I actually know more stories about Abbeys tricks than I do about my own banks..so its pretty tough for Abbey to keep using the same tacticts when everyone is now aware...and prepared to take them on even more.

Dont be put off by the negative stories........instead read the settled claims, proof enough that you too will come out with your charges if you do it right.

so heres the second post to keep the interest going !!

Question Re: Have started at last.

I've now got the last years statements, and have chased up the microfiched info.

I am going to follow this through, but one thing is really worrying me... I have a £2k overdraft, which I currently need to keep me afloat each month (due to the charges I have paid over the last 6 years, I estimate they've had £6k+ from me). Can they remove this without warning now that they know what I am doing and that I intend to take action against them?

My husband works away and we're on hols next week, so I can't get in to town to open a new joint account right now! Also, as I work in a school and have broken up for the summer hols, I wouldn't know who to get in touch with to transfer salary details etc.

(more worried about o/draft removal at moment.... having nightmares that I'll be stuck on holiday with no spends and 2 bored kids if they do pull the plug!)

Afraid its something thats unavoidable and thats their call if they want to do it.
They would give you notice of their intention to do this tho beforehand.
Usually they will at first hand reduce it as opposed to pulling it altogether.

Try to stay within the limits of this and do try and find the time for a parachute.

Theres no telling if it will happen or if it wont but its best being prepared !
