Default Us versus Abbey

Sent 1st letter from both of us to Abbey on 14/6 with £10 cheques, received letter re microfiche stuff etc and saying 40 day not applicable to archived stuff - and they banked the cheques for it. Then received a years worth of statements for both of us - all in seperate envelopes with mailshots (my poor postman!!) - estimated 2 grand between us without interest. God only knows how much will beon the other 5 years when we eventually receive them!! Do we wait for the microfiche statements or do we proceed with the next letter after 40 days, any advice will be greatly received!! Fantastic site..

Sorry for posting on your thread with questions not answers but i'm about to send my first letter and was wondering if they have said if they are going to charge you for the statements? My partner had a few tax man issues recently and had to prove he was not self employed by sending bank statements to them and when asking abbey for some statements he was charged £5 each!

Send the 1st letter in the library (data protection Act !!! - Subject accesss request) and enclose a £10 cheque like it says - we both did and they sent us a years worth of statements each and said they will use the £10 to get the rest of the statements off microfiche. I think its the way the letter is worded that does the trick. I think if you were to just ask them they would try and charge you. Hope this helps...

Hiya could you both start a personnel thread for your cases under the designated bank section.
Once you have made your thread post all relevant activity under that one thread, this way we can view your contact and help as needed.

welcome to the crazy world of bank wars and have a break in teh Bear garden when you are settled in.

Default Joanne versus Abbey

Has anyone had any problems opening another account. I sent my first letter to Abbey and in the process of waiting for statemnts. I took advice and decided to open another account. Popped into HSBC with passport and Council tax bill as proof of address. The lady questioned me quite a bit as to why I wanted to open another account (didn't tell her I was sueing Abbey) just said my present bank had higher charges etc etc, she then said she would need to see a bank statement with my present bank to look at the state of my account. Only then would they decide to let me open an account. Can anyone suggest an easy way of opening a parachute account with a bank other than Shabbey?

Yes - both of us do but reluctant to let new bank look at statement with Abbey as I have a £1000.00 overdraft which I am just inside and a few charges on last statement (not worked since I had my little girl - was full time with regular income before that). Are there any banks out there that will just let me open an account with relevant i.d?

Quite easy to open a basic cash account with most banks, and a number online. What you have to ask yourself is do I realy want an account with this bank. HSBC as far as I can tell are no better than the bank you are with, so it realy does not matter what bank you open a new account with they will all try to rip you off the same, price fixing surely not.

Just opened a new account with Nationwide and sent last months bank statement from Abbey, not good reading but nationwide still let us open a cash account, must have been rubbing their grubby hands together when they see our £2000.00 overdraft and charges.

Just bare in mind whatever bank account you open they want to profit from it.

Regards bish.

John welcome to the site.
Take some time to read up on the claims process.
There are many Abbey cases here so you should find out all you need
Start your own thread too so others can follow your progress.

Hello

We are in the process of trying to get back £11,000 bank charges from the abbey plus interest. We have received our statements and have written to them asking for the money back cannot wait to get their reply!! Keep in touch and will watch your thread to see how things are going for you. Its all of us against the Abbey!! We have opened a basic account with Nationwide just in case Abbey decide to be stroppy as we have an £800 overdraft and if they decide to take this we will be in a difficult situation.

Catherine this a very large amount and if you want it in the small claims will have to be split up (5k the max per claim) excluding interest.
How far down the road are you?
Maybe you should get some advice from a mod as there are complications with the big claims and you may need additional advice.........

Sent recorded letter to Abby today - 13/07 telling them they are not complying with data protection etc and I want the rest of the statements, and they only have 14 days remaining - and made appointment with Halifax to open an account (parachute account) tomorrow. According to their leaflet they do credit checks - Hope mine is ok!! Not going to drop this now. Going all the way - scary though !!
