Default Account closed and with DCA. Help!

Hi, would be grateful for some advice.

My account current account has been closed and passed to a debt collection agency-total overdraft, all charges, of approx. £150.
We had a serious health situation with one of our children and we really took our eye of the whole situation-we did contact Abbey via email and inform them that they had incorrectly charged us for two cheques that we had asked customer services to stop. They ignored that email and logged a default on our credit file, closed the account and passed it onto a DCA.

No that homelife has calmed down I really am furious at this and would like to know if there is anything I can do to get this sorted out. I don't care about the account as I wouldn't now bank with them if they paid me but I would like the default removed and the amount cleared (all made up of charges which, I feel, should never have been incurred in the first place).

Would be grateful for any advice on how, if at all, I can proceed. Thank you.

Hi my reading is that you claim back charges and any interest applied to those charges with the proviso that as the default value is made up of charges plus any interest applied that this is an unlawful default. It will not be easy but can be done.

They will apply for a stay to the case but you could apply to the court to remove the stay due to hardship and include the default in that application they may lift the stay, may not.
