It was initially probably set up (and increased over time as a result of charges). But it had not accrued due to bank charges (iykwim)
My problems at the time were the lack of notice from them (I received a letter saying ' your overdraft if due to expire next month, you need to pay it back' or words to that effect) and their lack of understanding. |

However, do you know how much they have taken from you over the past 6 years in charges.
If the amount is more than your OD limit, then it's conceivable that the OD wouldn't have been required if the unlawful charges hadn't been imposed, and therefore you would be due this money back - also, you could demand on the same argument that the default be removed.

1. Send a Data Protection Act Request
2. Once recieved, add up all the charges
3. claim them back regardless of how much it is and follow the step by step process in the FAQ section.
4. if your charges equal to the amount you had for an overdraft, you can start a claim to have the default removed aswell- because without the charges being applied to your account you wouldnt have needed an overdraft you couldnt pay back. |
