Default Jimbo v Abbey

Hi all. Wonder if anyone can advise me on this.

I've sent the Subject Access Request to Abbey with reference to my old account with them which went from about 1993-1999. They sent me a poxy little single page listing a few transactions and few charges and kind of said 'that's your lot son.'.

So I did them for Data Protection Act breach in court and received their defence today. They state that they cannot provide the earlier information because they don't store it.

Is this a valid defence? Is there a way of going after them with estimated charges? Anyone help?

1/5/07 LBA for Data Protection Act breach sent (41 days since S.A.R - (Subject Access Request))
15/5/07 Proceeding started at County Court for Data Protection Act breach (56 days since Subject Access Request)
30/5/07 YB filed acknowledgement of service to claim indicating intention to defend.
7/6/07 Statement pack 1 of 2 arrives containing £912 worth of charges - and that's going to be the lighter of the two packs!

Abbey will say that they only keep records as far back as 6 years from today, and after the new regulations came in from last December, that is all they are obliged to keep, so dont expect anything from before Feb 2002, but you might get lucky
