Hi,
I,m just in the process of sending my request for payments letter(£6584.71), and feeling rather nervous as abbey are looking for a settlement on my old joint account of £1994. I need to call them about the payments i've been making over the past year, since my husband left the home, and i,m not sure what to say to them.

I would get your letter requesting payment to them immediately. Then if you feel you have to phone them just tell them that you have put a letter in the post to them. Do not enter into any further conversation, cut the call short if you have to.

I am in the process of claiming against the Abbey and have today sent off my request for payment, so I am going through the same process as you

My only other concerns now would be, if they close my other accounts and I also have a mortgage with them!!

I have a mortgage with the Abbey as well, but they would be very stupid to ask for repayment of a mortgage, especially how much loan interest they get. Also I do not believe they have threatened to do this yet, just imagine the media coverage on that one!!!!

I have now received a standard reply from Abbey, "We are sorry you're not happy etc. I understand that the next thing would be to send a LBA.
My query now is as the amount exceeds the £5000, would it be better to put in two separate claims?
Having had to give up work I am on ltd funds, mainly carers allowance and Tax credits, I am concerned about the court costs.

Any advise would be appreciated.

At present I believe you just send your LBA for the full amount, but you might need to split the claim when you actually do the court claim. Perhaps a Mod can clarify this.

If you are on allowances and tax credits I think you might pay a reduced court fee.
