Unhappy Debt Recovery over bank charges Help

Hello there I am started to worry now as I recieved a letter from moorcroft debt recovery saying they want £620 from me to pay Abbey National back. I explained Abbey national have paid myself back nearly £1100 as a gesture of good will and I am now waiting for the bank charge court case against the 6 banks to then continue my small claim as the court have stayed my claim until the results come through as Abbey requested. I refused to pay the £40 requested by moorcroft and they now say thje will add their charges to the abbey claim which will be aprixamately £250. Please can anyone help what do I do now?

Hello,

The same thing has happened to me recently.

Moorcroft of fond of this type of behaviour, and will make all kinds of threats to get payment.

I would write to Moorcroft explaining that you welcome the chance to discuss this case in court, and have all your paperwork at hand, including details of the stay requested by Abbey. Explain that you will also request court fees and a wasted cost order from Moorcroft should they proceed with such an action.

Hi Higgins

I am presuming from your post that you spoke to Moorcroft on the ‘phone? The first rule of thumb with regard to all DCAs is NEVER to speak to them on the ‘phone and request that all correspondence be in writing only as telephone conversations can be denied and you made proof of correspondence if you decide to complain in the future.

I’m quite surprised that Abbey have passed this to Moorcroft when they have already made a payment to you and have stayed your claim as this effectively puts the account in dispute with them.

Did you receive a letter from Abbey advising that Moorcroft had been assigned your account? (Notice of Assignment)

I would be inclined to file the letter the letter from Moorcroft under “ignore” and await any further correspondence from them. If they do contact you by ‘phone tell them that you will only correspond in writing – do not enter into any conversation with them at all as they will say anything to get a payment from you.

Should you receive any more letters from Moorcroft, update your thread for further information.

NP. FWIW your advice is similar to my own coarse of action (and I didn't recieve any notice of allocation) although I would love them to issue proceedings and argue this in court, but that's just wishful thinking I think.
