Default Over £5000 ???? Fast Track anyone

Hi to all
A new thread but very important to my claim.

I have calculated on the statements that I have to hand going back 6 years that shabby have liberated over £5800 (not including adding 8% interest) from my account. If I take this to small claims under the procedures already outlined in the forums I would only be able to claim £4999 realisticly. This would mean that I would have to reduce my claim and indeed miss out on charging them 8% for the joy of having my money.

1) Can I split the claim?

2) Has anyone as yet tried to sue for over £5000 using fast track?

I would appreciate honest views on this, as I am considering taking this course so as to claim my full peneth back from them.

If it wasn't for close family we would never have been able to cope with the charges levied against us, and indeed may well have gone completely under. So my feelings are for my family as well and to try and get every penny back, as I am of course indebted to them for helping.

Many thanks in anticipation.

Andrew

hiya, if you do a search on sever or fast track it should bring up a number of threads regarding this,

the general opinion appears to be split your claim, claim the oldest charges first up to just under £5k and once that is settled start again for the other £800 odd. (Oh and the £5k is before you add interest 8% and court costs)

but have a read about and you should be able to make a more informed decision.
