Default Couple of Initial Queries

Hello,

I'm new at this. A friend of a friend mentioned claims against bank charges and it snowballed from there. This site with the FAQs, all the discussion threads (the advice to read through threads is really helpful as it has prepared me for the expected 'fob' off letters), clearly laid out technical stuff and brilliant support makes me feel pretty damn good about squareing up to the banks. I do have a couple questions though.

Firstly, the initial claim I'm making is for my husband (I'm doing the spade work for him) on his Abbey account - but we also have a fairly new joint Abbey acc, which we've barely had charges on. Is any action on his account likely to affect our joint account?

Also, I'm 28 weeks pregnant (don't mess with a pregnant woman with hormones raging), should I prepare myself for this to continue after little one is born? Unfortunately I need to send off the Data Protection Act letter as we're looking into the full 6 years of charges, adding delays. Letter goes off tomorrow - with £10!

Just one last point, received a statement from Abbey on our joint acc at the w/e saying that we were being charged £20 for going overdrawn £1.12 for a bounced cheque a month or so ago EVEN THOUGH we had already been charged £20 and £30 for the bounced cheque. I rang Abbey and was advised that because our statements are dated 26th to 25th of the month the overdraft had lasted through two statements (by a day or so) and we were being charged for being overdrawn for each statement!!!!? I argued with this and was told in effect that I should be grateful that I wasn't being charged £20 for each day of being overdrawn. I asked for her manager details but she said it wasn't company policy to give it out. I finished the call. My husband rang back and spoke to another girl who denied the second charge??? He finally spoke to a chap who was very helpful, totally agreed that £70 was an outrageous charge for going £1.12 overdrawn and credited our account £70! My husband asked for his manager's name so that he could write to commend the member of staff. Amazingly the chap asked that my husband speak to him direct to tell him how good he was, which he did. My husband was very grumpy with the manager but at the same time commended the member of staff for seeing sense.

We decided that we would go ahead claiming past charges because it seems fundamentaly Abbey staff consider the charges to be wrong.

Thank you for any advice you can give on my two queries at the beginning of my thread.

1. They could close your husband's account, but this shouldn't affect your joint account, unless, of course you subsequently claim on that too. You might want to look into opening a parachute account with another bank for your husband.

2. Sorry, can't make you unpregnant.

welcome pussycat,

may i suggest going into your branch with your Data Protection Act and money, at least you will be able to start the 40 days from there and then. whereas ny posting it you have to give them time to get the letter and clear the postal order or cheque, whichever it is you will be doing.

if you think that it may be too much to take on when you have a newborn baby in your arms, i wouldnt worry too much about that as the first few weeks they sleep most of the time.!!

keep your husband upto date on everything, therefor he will be able to take over if necessary.

also keep a little note of everything saying when you sent things off (keep copies) and when they replied, save these to.

good luck, dont worry too much about it or you could go into early labour (dont want that)

Default Future Mortgage/Re-Mortgage

The stage we are at presently is that the Data Protection Act letter (requesting 6yrs of info) has been faxed to the Abbey DPA in MK, original to follow in the post today (+£10). We just want to get an idea of how much they owe before we take the plunge so to speak.

One concern we have is whether legal action could affect any future mortgag/re-mortgage application (inc with Abbey) as we need to extend our house in the next year or so. Our mortgage is with IF (with associated accounts/jars), we also have a joint Abbey account. Apologies if this is obvious and Abbey wouldn't touch us with a barge pole!

Is there anyone out there who has successfully made claims against more than one bank and has this affected them when applying for mortgages/remortgage with a High St bank - rather than some obscure higher interest rate mortgage provider?

If our application was seemingly affected - where would we stand legally as it would seem wrong for us to be penalised for our Abbey issues on one account.

Apologies but I couldn't clearly see anything answering this in FAQs but I have been reading this site so intensley the last few days I have become a bit FAQs blind.

Thanks for any help anyone can offer.

Interesting question to which I would also like the answer I will be in the same predicament
I also asked wether or not you can take a bank to task /court if they close your account down , but i havent had a reply to that either...........

does anyone know?????

Default Falling At The First Hurdle

I'm really sorry to let the side down but it looks like we won't be taking our claim for charges any further (we've yet receive Data Protection Act details). Early yesterday I posted a thread asking how a claim could affect any future mortgage/re-mortgage application with High St banks (rather than an obscure high rated mortgage lender) - if Abbey were to close the account we were claiming on. Unfortunately no one was able to comment out of general knowledge or personal experience. Although a fair few people did read the thread, so there seems to be a lot people interested in this point.

Like I say, sorry to let the side down but we just can't risk it. Of course if anyone can answer I would be really grateful!!!!

Perhaps if the question is re-phrased?

People open and close accounts all the time. Such activity is recorded on your credit record and may have an effect. I don't know if things like the reason for account closure are recorded

There's no right or wrong answer here - each institution treats the information in it's own way.

The best advice would be to learn more about credit histories.

It's really too early to tell. This forum has been going for 6 months. People are only recently started to get their money back, and I doubt any of them would be mortgaging so soon...

Logic says it should make no difference. Banks are not necessarily logical. If you're that wobbly, wait until you have your mortgage sorted, then get your charges back!


And I have merged your threads, as it's really impossible to follow your story if we have to chase it all over the forum. Please keep to one thread for future queries and updates, thanks.
