Acquisition Order by Abbey- ***Urgent***

Hi I am posting this on behalf of a friend who has gone through a horrendous time, basically her ex-partner took out a secured loan on her home (deeds are in her name only) he signed the papers forging her signature and then done a runner with over £30k....

The Loan Company wrote to my friend asking for payment of the loan (which she knew nothing about) and then raised court action against her when she refused to pay. A solicitor is dealing with this case and handwriting experts have been brought in to prove it is not her signature, but they refuse to drop their action.

As the Loan Company are taking legal action now her Mortgage company (Abbey) are taking action to (there are arrears on the account due to Housing Benefit fiasco which is a whole other thread!), a court date has been set for the end of September.

The Abbey are applying for an acquisition order - we think is like repossession but not sure and unless she can come up with nearly £3k by next month then the court case will go ahead.

Is there anything we can do to delay the court case and gain more time to sort the arrears?

Would raising a claim about the charges that have been applied to the mortgage account stop the Abbey from taking further action?

She is absolutely desperate, any advice very much appreciated.

As she already has a solicitor involved I would suggest that he deals with the whole thing.
Just one point she cannot claim housing benefit on a mortgaged property.

Sorry it's not housing benefit but mortgage interest relief or something.

The solicitor advises to take out a loan to pay off the arrears to stop the Abbey action, a loan that she just can't afford!
