Question Can anyone help with this order?

Hi all.


I could do with a little help.


I was told last week, during a visit to my local Court office, that my claim was to be stayed and that I would receive written confirmation in the post in a couple of days. Well it arrived this morning and it reads as follows:-

Before DISTRICT JUDGE WILLIAMS sitting at Caernarfon County Court, Llanberis Road, Caernarfon.


Upon the Courts own motion. The Court has made this order of its own initiative without a hearing. If you object to the order, you must make an application to have it set aside, varied or stayed withis 7 days of receiving it.


IT IS ORDERED THAT

  1. This file be transferred to the Cardiff Justice Centre for consideration by the Designated Civil Judge.
  2. The Small Claim hearing listed at Caernarfon County Court be vacated.

All enquiries and applications to be made to the Cardiff Civil Justice Centre, 2 Park Street, Cardiff

The order doesn't exactly say that my claim is being specifically stayed. I would however, be eternally thankful for any advice regarding the above order.

It looks to me like the case has been transfered to another court. It doesn't mention a stay at all.

I can't understand why they would transfer the case to Cardiff, three and a half hours drive away, while I live 10 mins away from Caernarfon. I am absolutely frothing at the mouth. I'm sure if the doc saw me now, he'd give me a rabies shot.

Do Abbey have a branch in Caernarfon?

If they do then you need to object to the order and make an application to have it varied within 7 days of receipt.

Abbey's branch is in the middle of town. The court building is just 5 mins walk away. 2 mins if you take the bus.

I phoned Cardiff this morning and was told by a very nice chap that all bank charges claims from Caernarfon are being transferred to Cardiff to be handled by one judge. It would be almost pointless for me to apply for my claim to be transferred back to Caernarfon. He also said that any claims transferred to Cardiff are automatically stayed. I just don't know what to do now!
