Hi all I am new to the Abbey forum.

Sent Subject Access Request to abbey 12th July 2006 I didn't have the account number as the account was closed around 2003 also at a different address to the one we had when we were with them,so gave them the old address and our dates of birth.
Got back a form to fill in re change of address and the cheque which was to be returned with the form, filled that in sent back 31st July and back it came again 17th August with the cheque still attached I hadn't sent a copy of the letter they had sent with the account number on it.
It has be returned again(with a copy of the letter) to them, my question is when will the 40 days start as they kept returning the cheque or will it be down to proof of posting.

Abbey's 40+2 days were up on the 23rd August does the time still apply if they kept sending back the cheque?
Or should I just fire off the non compliance letter.
Any advice would be appreciated.

that is excellent, I must say that I dont really have much good to say about Abbey but she is and has been an excellent ambassador for them, she is polite, knows her job and doesn't shirk her duties, Well done Abbey in getting something right.

And of course Mrs C I am very pleased for you too as she is as good as her word.

Hi MrsC, well do you now have the account number? it sounds such a shambles, I think that I would be tempted to start again, but saying that, they should have been able to find an account number with your name and address. I would see where you can get by emailing sheena.small@abbey.com, telling her your story, I will be very interested to see what she comes back with, if they dont accept the cheque for whatever reason, that is there problem (unbless the cheque is wrong, obviously!)

There was no problem with the cheque first time they sent it back was because I live at a different address so filled out their form and sent it together with proof of ID(31st July) then it came back again saying they didn't have the account no on the form (it was on their letter to me) so resent that back again with the cheque 17th August Non compliance was sent 10th sept so I will try the sending an email and see what happens from there

Thanks for the help

Okay email sent worked out how many days and it's 111 days since my first request and 75 days if they are taking it from the 17th aug when I returned the form with the account no.

And I have just remembered that I put a copy of the letter with the account No in with the form the first time I sent it back.

Update

Received statements today they only go back to 08/01 and in the attached letter it state's "Historical information can only be retained if there is a legitimate reason for processing the data in accordance with the rights of an individual. Therefore, due to the time elapsed, some of the original account records have been destroyed in line with our retentions policy.

Is this the same for everyone else or has anybody got statements going further back than this ?

Had a quick look and on one day alone there is 7x £10 cleared transaction charges

Hiya, yes it is the same for everyone, there seems no way that we can squeeze more information out of them past 6 years, they must be so busy destroying all that data!
